L,I <br />COUNCIL AGENDA REPORT <br />October 11, 2013 <br />MAYOR AND TOWN COUNCIL / <br />GREG LARSON, TOWN MANAGER <br />SUBJECT: INFORMATION REPORT — POTENTIAL AMENDMENTS TO TOWN <br />POLICIES REGARDING COMMUNITY BENEFIT <br />RECOMMENDATION: <br />Discuss the Community Benefit Policy and provide direction to staff to make changes to Town <br />policies regarding Community Benefit. <br />BACKGROUND: <br />A joint study session with the Town Council and Planning Commission was held on August 22, <br />2011, to discuss potential amendments to the Town's In -Fill and Traffic Policies regarding <br />community benefit (Attachments 1 and 2). The basis for the study session was to discuss several <br />issues that the Town Council, Planning Commission, and Town staff had identified relative to <br />the Town's use of community benefit. Following is a summary of directions suggested from the <br />study session: <br />Community Benefit should be replaced with a revised fee structure that is directly related <br />to the impacts of the project. <br />Planned Developments should be required to have community benefits /amenities. <br />Consider eliminating the term "community benefit." <br />DISCUSSION: <br />Pursuant to action item CD- IS. 1 of the General Plan, the Town Code is to be amended to include <br />a definition of Community Benefit that clearly differentiates it from exactions. In order to <br />implement the General Plan action and the directions suggested from the joint study session <br />summarized above, staff is proposing the following for Council consideration: <br />Amend the Traffic Impact Policy and study traffic impact fee increase - The Town's first <br />policy related to traffic impacts was the Town -Wide Critical Intersection Impact Policy <br />PREPARED BY: Sandy L.
