SUBJECT: PPW JOB NO. 12 -13 — PAVEMENT REHABILITATION -CRACK SEAL

AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF S. MILLER PAVING INC. AND AUTHORIZE RECORDING BY THE
CLERK ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work, of S. Miller Paving Inc. and authorize recording by the Clerk Administrator.
BACKGROUND:
On November 2, 2010, Santa Clara County voters approved Measure B, which levies a $10
annual Vehicle Registration Fee (VRF) on cars owned /registered by county residents. The fees
are to be used to pay for local roadway improvements, including pothole repair, pavement
repairs, and other roadway safety projects. Street improvements were completed on Blossom
Hill Road, Oka Road and Lark Avenue through this project.
All revenues collected through the VRF remains in Santa Clara County, and will be distributed to
cities to assist with funding roadway repair projects. The Town received approximately
$151,000 in revenues from the County during FY 2012/13, which can be used for this project.
This project was designed to perform base repairs, pothole repairs, crack sealing, and asphalt
patching on streets throughout the Town and on hillside roads.
DISCUSSION:
On May 6, 2013, the Town Council awarded the contract to S. Miller Paving Inc. The contracted
work has been satisfactorily completed by S. Miller Paving Inc. and is being recommended for
acceptance by the Parks and Public Works Department.

DISCUSSION (Cont'd.):
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and /or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of S. Miller Paving Inc. and authorize
recording by the Clerk Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
This project was completed within the Council approved budget, as demonstrated in the fiscal
table below.
