Open and hold the public hearing. 2. Close the public hearing. 3. Adopt resolution approving the Comprehensive Fee Schedule FY 2013/14, to continue certain department fees, rates, and charges, amend certain fees, rates, and charges for FY 2013/14 and establishing a fine to allow enforcement of Town of Los Gatos Town Code Section 15.40.275, parking, etc., in alleys restricted to loading or unloading (Attachment 1). BACKGROUND: The Town's financial policies require that certain fees, rates, and charges for services be maintained to allow for cost recovery -based on the actual cost to- provide- Town services. "Fee" activities are services and functions provided by the Town to individuals who receive some direct material benefit above and beyond services offered to residents at general taxpayer expense. Annually, the Council adopts a Comprehensive Fee Schedule, which lists all of the Town fees. Staff periodically reviews the cost of providing such fee -based services and, if supported by cost data, fee modifications are recommended. The last user fee study was completed in April 2010. The purpose of the study was to review the Town's current fee schedule, calculate the total cost of fee - generating services, analyze the cost recovery levels for each fee, and provide recommendations on how to reclassify or adjust fees annually. While all Town fees were evaluated, the user fee study primarily focused on Community Development (Planning and Building), Engineering, Police, and other administrative fees. DISCUSSION: The Comprehensive Fee Schedule allows for an annual adjustment of fees by the average increase in the Consumer Price Index (CPI) for the pervious calendar year. The average increase in CPI for 2012 was 2.7 %. Attached for Council reference is an updated FY 2013/14 Comprehensive User Fee Schedule (Attachment 2) reflecting all Town fees (including proposed changes) and an itemized list of recommended FY 2013/14 fee adjustments, reclassifications, and deletions, including those to be adjusted by the average Consumer Price Index (CPI) (Attachment 3). The proposed FY 2013/14 Comprehensive Fee Schedule accounts for modifications to fees, including Development, Library, Parks and Public Works, and Police Fees as explained below: Development The proposed modifications to Development Fees have been made to further clarify fees and ensure that they remain aligned with current operating and construction costs. The recommended changes are related to Development Services, General Development Fees. Specifically, these fees are being modified as described below: Subordination Processing Fee - The Subordination Policy was approved by Town Council on January 22, 2013 and the staff report noted that a Subordination Fee to cover staff costs in reviewing proposed subordination requests and routing of signatures for execution to Town Attorney's Office and Town Manager's Office would be included in the proposed fee schedule. The proposed fee is $500 per subordination request and is based on a similar fee charged by other jurisdictions. Staff anticipates that 2 -4 subordinations will be requested for new units. Anticipated revenue is $2,000. 2. Several fees for reports to be copied have been adjusted and are based on the number of pages within the report. Library The Library is proposing that the Proctor Fee be removed from the fee schedule and deleted as proctoring is no longer offered as a library service. PAGE 3 MAYOR AND TOWN COUNCIL SUBJECT: ADOPT RESOLUTION CONTINUING CERTAIN DEPARTMENT FEES, RATES AND CHARGES, AND AMENDING CERTAIN FEES, RATES, AND CHARGES FOR FY 2013/14 March 18, 2013 Parks and Public Works The Parks and Public Works Department is recommending two modifications to the fee schedule as described below: 1. The Creekside Sports Park facility use fee has been added to the Fee Schedule because it is a new Town facility. The fees account for general maintenance and staff time to open and close this gated facility. 2. Park fees, such as the bocce ball court and jump house use permit, have been incorporated into the Town's Fee Schedule. They are consistent with existing online park reservation fees for use of these items at park facilities. Police The Police Department is recommending fee modifications for Parking Permit Fees and Taxicab Fees as described below: 1. Taxicab fees - Chapter 29 of the Town Code provides for issuance of a Certificate of Public Convenience and Necessity and for issuance of a taxicab driver's license and payment of application fees and annual renewal fees in connection with the certificate and license. 2. Police Alarm Fees — In September 2009 the Town Council approved a sliding fee schedule for false police alarm calls. The Town of Los Gatos Police Alarm Ordinance section 14.50.010 addresses police alarm fees for false alarms, payment, appeals and no response status. Per section 14.50.225, such fees will be charged when there is a reported two (2) or more false alarms within a six -month period within a calendar year. This is an update to the fee schedule to reflect these previously authorized fees. 3. Parking Permit Fees a. Residential Parking Permits: Lost permit replacement and damaged permit replacement were increased to be in line with the same fee under Business Parking Permits. b. Business Parking Permits: The standard and premium employee monthly and the premium annual parking permits were anticipated to be put in place last year. Business owners opposed this program and, thus, it is not being implemented. In addition, the Police Department is recommending a new fine, in the amount of $42.00 to enforce Town of Los Gatos Code Section 15.40.275 which states that no person shall stop, stand, or park a vehicle for any purpose other than the loading or unloading of persons or materials in any alley. At the present time, there is no fine associated with this ordinance; therefore parking control is unable to enforce violations where alleys are blocked. PAGE 4 MAYOR AND TOWN COUNCIL SUBJECT: ADOPT RESOLUTION CONTINUING CERTAIN DEPARTMENT FEES, RATES AND CHARGES, AND AMENDING CERTAIN FEES, RATES, AND CHARGES FOR FY 2013/14 March 18, 2013 1. Fine for Parking in Restricted Alleys - State law authorizes the Town to recover parking penalties for parking violations, late payment penalties, administrative fees, and other related charges for parking violations. Section 40203.5 of the California Vehicle Code authorizes a city to establish a schedule of parking violation penalties and late payment penalties for parking citations in its jurisdiction. The Police Department recommends establishing a $42.00 fine for Town Code Section 15.40.275. This fine amount is the same as other Town parking violations established by Council in March 2011. The Town Parking Enforcement Officers utilize hand held electronic citation writers; therefore the department has the ability to quickly reprogram the citation writers to accommodate the new parking penalty amount. Once adopted by Council, fees are effective after a protest period of at least 60 days. As noted in the attached Resolution (Attachment 2), the recommended fee adjustments and new fee would be effective July 1, 2013. CONCLUSION: It is recommended that Town Council approve the recommended adjustments to the Comprehensive Fee Schedule, including the establishment of a fine of $42.00 to allow enforcement of Ordinance 1968 — Town Code Section 15.40.275, Parking, Etc., in Alleys Restricted to Loading or Unloading and authorize fee to be added to the Fees and Fines Schedule effective July 1, 2013. FISCAL IMPACT: The Town's financial policies require that fees be maintained to provide for the recovery of costs associated with Town services. The proposed fee adjustments reflect an increase in the CPI, and, therefore, better represent the cost to deliver services. Staff will incorporate the fee changes into the Town's FY 2013/14 Operating and Capital Budget using conservative activity projections. Further fee increases will be brought to Council for its review during the budget process, to move toward full cost recovery of fee -based services. WHEREAS, State law provides in Vehicle Code Section 40203.5 that parking penalties shall be established by the governing body of the jurisdiction where the notice of violation is issued; and WHEREAS, Town Code Section 15.40.275, Parking, etc. in Alleys Restricted to Loading or Unloading, states that no person shall stop, stand or park a vehicle for any purpose other than the loading or unloading of persons or materials in any alley; and WHEREAS, with the establishment of a $42.00 fine associated with Town Code Section 15.40.275, the Los Gatos /Monte Sereno Police Department can enforce parking violations for parking in alleys within the Town of Los Gatos. NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY RESOLVE: 1, That Resolution 2012 -017, "Resolution of the Town Council of the Town of Los Gatos Adopting Continuing Department Fees, Rates, and Charges, and Amending Certain Fees, Rates, and Charges" is hereby rescinded; and 2. The Town Council of the Town of Los Gatos, County of Santa Clara, State of California, that the Town of Los Gatos hereby adopts a $42.00 fine to allow enforcement of Ordinance 1968, Section 15.40.275, Parking, Etc., in Alleys Restricted to Loading or Unloading; and 3. The Town Council of the Town of Los Gatos authorizes the fee to be added to the Fees and Fines Schedule effective on July 1, 2013; and 4. The Town of Los Gatos Comprehensive Fee Schedule, attached hereto as Exhibit A, shall become effective July 1, 2013. The Fee Schedule will be adjusted annually by the average Consumer Price Index (Bureau of Labor Statistics, U.S. Department of Labor for the San Francisco /Oakland /San Jose Metropolitan Statistical Area) for the calendar year and /or by the percentage increase in actual operating costs for the current year — whichever is greater.
