NOT TO EXCEED $98,351.
B. AUTHORIZE STAFF TO EXECUTE FUTURE CHANGE ORDERS TO
THE CONSTRUCTION CONTRACT AS NECESSARY IN AN AMOUNT
NOT TO EXCEED $10,000.
RECOMMENDATION:
1. Authorize the Town Manager to execute a construction contract with Bearden Construction
Co., Inc. dba CB Concrete Construction, Inc. in an amount not to exceed $98,351.
2. Authorize staff to execute future change orders to the construction contract as necessary in an
amount not to exceed $10,000.
BACKGROUND:
The adopted FY 2012/13 — 2016/17 Capital Improvement Program (CIP) Budget designates
funds for improving the condition of Town parks and facilities and is consistent with the Town's
goals to improve the quality of public infrastructure in Los Gatos.
The construction of the Los Gatos Creekside Sports Park is underway and on schedule. During
the Creekside Sports Park design process, safe and convenient pedestrian access to the site was
identified as a priority. Current access is made difficult by the fact that the sidewalk on
University Avenue exists only on the west side of the street.

SPORTS PARK 813 -0210
DISCUSSION:
During the Master Plan approval process, the Town Council recommended that staff explore a
way to ensure that pedestrians can safely access the Creekside Sports Park from Lark Avenue.
This project will construct a new sidewalk from the driveway entrance to the Sports Park to Lark
Avenue, along the east side of the street.
The new sidewalk along the east side of University Avenue will be similar to the existing
sidewalk on the west side of University Avenue with a meandering style in the landscaped area.
The neighboring commercial properties are all in support of this project and look forward to the
construction.
At the regular Town Council meeting held June 18, 2012, the -Council approved plans and
specifications for this project and authorized staff to advertise the project for bids.
On July 18, 2012, three bids were received for this project (Attachment 1). Staff reviewed the
bids received and determined that Bearden Construction Co., Inc. dba CB Concrete Construction,
Inc. is a responsible entity and was the most responsive to the Town's formal bid process.
This construction work for this sidewalk is scheduled to be completed in advance of the opening
of the Los Gatos Creekside Sports Park in October 2012.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a construction
contract in an amount not to exceed $98,351. Additionally, due to the variables associated with
this particular type of construction and to address unforeseen circumstances that may occur
during the project, staff further recommends that the Town Council authorize staff to execute
future change orders- to the construction contract as necessary for work not in the original base
bid, in an amount not to exceed $10,000.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A
Notice of Exemption will not be filed.
FISCAL IMPACT:
There are sufficient funds for this project as demonstrated in the table on the following page.
