;1]:71] 1► /\► �$�1y7 <br />ORDINANCE OF THE TOWN OF LOS GATOS <br />AMENDING THE TOWN CODE EFFECTING A ZONE CHANGE <br />FROM RM:12 -20 TO RM:12 -20:PD <br />FOR PROPERTY LOCATED AT <br />135 RIVIERA DRIVE <br />THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS <br />FOLLOWS: <br />SECTION I <br />The Town Code of the Town of Los Gatos is hereby amended to change the zoning on <br />property at 135 Riviera Drive (Santa Clara County Assessor Parcel Numbers 529 -13 -016, 529 -09- <br />027, 031 and 034) as shown on the map attached hereto as Exhibit A, and is part of this Ordinance, <br />from RM:12 -20 (Multi - Family Residential) to RM:5 -12:PD (Multi- Family Residential, Planned <br />Development). <br />SECTION II <br />The PD (Planned Development Overlay) zone established by this Ordinance authorizes the <br />following construction and use of improvements: <br />1. Retention of 123 existing apartment units (24 to be converted to affordable units). <br />2. Removal of existing pool, landscape improvements and carports. <br />3. Construction of 50 new apartment units within four buildings. <br />4. Construction of a new pool and spa, fitness and leasing centers, and carports. <br />5. Designation and implementation of 25 affordable units; 24 low income units within existing <br />buildings and one moderate income unit in a new building. <br />6. Landscaping, private street, parking and other improvements shown and required on the <br />Official Development Plan. <br />7. Uses permitted are those specified in the RM (Multiple - Family Residential) zone by Sections <br />29.40.610 (Permitted Uses) and 29.20.185 (Conditional Uses) of the Zoning Ordinance, as <br />those sections exist at the time of the adoption of this Ordinance, or as they may be amended <br />in the future. However, no use listed in Section 29.20.185 is allowed unless specifically <br />authorized by this Ordinance, or by a Conditional Use Permit <br />Page 1 of 26 <br />
