ORDINANCE NO. 1703 <br />ORDINANCE OF THE TOWN OF LOS GATOS AMENDING <br />CHAPTER 21 OF THE TOWN CODE RELATING TO THE <br />RELEASE OF CRIMINAL RECORD INFORMATION <br />ON PROSPECTIVE TOWN EMPLOYEES <br />The Town of Los Gatos hereby ORDAINS: <br />SECTION I. <br />Section 21 -13 of the Town Code is hereby amended to read as follows: <br />Section 21 -13. Criminal Conduct <br />Criminal histories may be considered in determining <br />whether prospective employees are likely to perform <br />suitably in Town employment. No person convicted of a <br />felony or misdemeanor involving moral turpitude shall <br />be eligible for employment in the classified or <br />unclassified service of the Town; provided, however, <br />that the appointing authority may disregard such <br />conviction if it is found and determined that <br />mitigating circumstances exist, such as, but not <br />limited to, evidence of rehabilitation, length of time <br />elapsed since such conviction, the age of such person <br />at the time of conviction, or the fact that the <br />classification applied for is unrelated to such <br />conviction. <br />SECTION II. <br />Section 21 -14 of the Town Code is hereby amended to read as follows: <br />Section 21 -14. Criminal Record <br />The Town Manager, Assistant Town Manager, Town Attorney, <br />and Chief of Police are authorized to have access to the <br />"State Summary Criminal History Information" as provided <br />for in Section 11105 of the Penal Code of the State of <br />California. Such access to this information is on a need <br />to know basis. <br />
