SUBJECT: SAFEWAY PROJECT EASEMENTS
AUTHORIZE THE TOWN MANAGER TO APPROVE MODIFICATIONS,
ABANDONMENT, AND .ACCEPTANCE OF NEW PUBLIC EASEMENTS IN
CONFORMANCE WITH THE APPROVED PLANNED DEVELOPMENT
ORDINANCE 2186 .(470 NORTH SANTA CRUZ AVENUE -SAFEWAY
PROJECT).
RECOMMENDATION:
Authorize the Town Manager to approve modifications, abandomnent, and acceptance of new
public easements in conformance with the approved Plamled Development Ordinance 2186 (470
North Santa Cruz Avenue -Safeway Project)..
BACKGROUND:
For the period of June 22 through August 1, 2010, the Town Council is in recess and there are no
regular Town Council meetings plaiuled. On January 19, 2010, the Planned Development (PD)
for the 470 N. Santa Cruz (Safeway Project) was approved by Ordinance 2186 by the Town
Council. The approved PD proposed modification to existing public easements based on the
proposed new improvements.
Under most circumstances, Town Council approval is required for abandoning or modifying
existing public easements. As proposed in the approved PD and associated Conditions of
Approval, the existing easements must be modified to incorporate the new project improvements
and must be approved prior to issuing permits.
