SUBJECT: PROPOSED VACATION OF A PORTION OF LAUREL AVENUE
(FARWELL AND ALLEN)

Enclosed is a request by Jim Farwell and Bob Allen for the Town to vacate a
portion of Laurel Avenue. Also enclosed is a map showing the street area
proposed to be vacated.
The portion of the street area proposed to be vacated is 20 feet wide
(leaving 40 feet of right-of-way), and slopes steeply up from the road,
rendering it useless for street purposes. Vacation of the 20-foot strip
is proposed as a solution to lot width deficiencies in a proposed two -lot
subdivision of the property.
Mr. Farwell and Mr. Allen were advised that the Town would probably require
a $100.00 processing fee for the vacation, and that they should satisfy
themselves that the land would pass to them upon vacation by the Town.
State law provides the following procedure for this type of vacation of
public right-of-way:
1. The Town Council adopts a Resolution of Intention to vacate excess
right-of-way, and sets a public hearing no sooner than 15 days
following adoption of the Resolution of Intention, and no sooner
than 10 days following advertisement of a Notice of Public Hearing
on Street Vacation.
2. Council holds a public hearing, and adopts an Order of Vacation provided
they find the portion of the street unnecessary for present or prospective
public street purposes.
It is recommended that the request of Mr. Farwell and Mr. Allen be referred to
the Town Council at their meeting of September 15, 1980. If the Council
desires to proceed with the vacation, it is recommended that they take the
following action:
1. Determine if a fee will be required to help pay for the cost of the
proceedings.
2. Set this matter for public hearing on October 6, 1980.
3. Adopt the Resolution of Intention.
