BACKGROUND: The San Francisco Bay Regional Water Quality Control Board (RWQCB) acts as the responsible agency for regulating water that enters streams and ultimately the bay, ensuring the water is clean and unpolluted in compliance with the federally mandated Clean Water Act. The RWQCB does this through the issuance of permits to local agencies (Municipal Regional Stormwater Permits) that require compliance with a series of regulations. The permits are issued regionally in approximately five-year cycles, with the last issuance in January 2016. The permits issued by the RWQCB contain requirements to control polluted discharges which escalate over time. These requirements are meant to increase accountability at the local jurisdiction level while allowing ramp up time for compliance. The West Valley Clean Water Program (WVCWP) ensures compliance with the regional permit for the Town and the cities of Campbell, Saratoga, and Monte Sereno. The West Valley Sanitation District (WVSD) has acted as the managing entity and fiscal agent for the program for a number of years but recently informed the participating agencies that it no longer wishes to provide these services. The City of Saratoga will take on the role of fiscal agent as the WVSD steps away. This resulted in the establishment of a Joint Power Authority (JPA) to conduct the ongoing operations of the program, as approved by the Town Council on February 6, 2018. As of June 30, 2018, the WVSD will no longer act as the fiscal agent. The one exception will be the continued collection of fees through property tax assessments. WVSD has committed to collecting fees for 2018 and 2019. This recommended action includes the assessment for both years to complete actions the WVSD commitments and approves the budget for the WVCWP. Subsequently the WVCWP will need to establish a replacement fee for future revenue. CONCLUSION: In May, WVSD staff will ask their board to approve the final details of the wind down of the program and the assessment of fees through property taxes for the next two years. The recommended action for this report aligns with the WVSD and WVCWP direction. COORDINATION: This report has been coordinated with the West Valley Clean Water Program and the West Valley Sanitation District. FISCAL IMPACT: The approval of this budget will allow the WVSD to continue to collect revenue on behalf of the Town to fund the WVCWP. There are no impacts to the Town’s General Fund as a result of this action. ENVIRONMENTAL ASSESSMENT: This is not a project defined under CEQA, and no further action is required. Attachment: 1.
