RESOLUTION 2018-
RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO EXECUTE A JOINT POWERS AGREEMENT
FORMING THE WEST VALLEY CLEAN WATER PROGRAM AUTHORITY
WHEREAS, in July 1992, the cities of Campbell and Monte Sereno and the Town of Los
Gatos (“Member Agencies”) were among the members of a Cooperative Agreement for
stormwater pollution control coordination with the West Valley Sanitation District (WVSD); and
WHEREAS, in 1994, the city of Saratoga became a Member Agency; and
WHEREAS, the coordinated stormwater pollution abatement, control and management
effort of the Member Agencies is now commonly known as the West Valley Clean Water Program
(WVCWP); and
WHEREAS, the West Valley Clean Water Program has been a successful and cost-effective
means of collaboratively addressing federal and state stormwater requirements and regulations
within the Member Agencies; and
WHEREAS, on May 10, 2017, the WVSD Board of Directors approved the withdrawal
from the WVCWP, and termination of the District’s participation in various legal agreements
with the WVCWP effective June 30, 2018; and
WHEREAS, the cities of Campbell, Monte Sereno, and Saratoga and the Town of Los
Gatos are interested in continuing to comply with the stormwater regulations in a cost-effective
manner, collaborate on regional solutions, maintain the benefits of a single clean water
program, and create a formal oversight authority.
NOW, THEREFORE, BE IT RESOLVED: that the Town Council of the Town of Los Gatos
hereby authorizes the Town Manager to execute the Joint Powers Agreement forming the West
Valley Clean Water Program Authority.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on the 6th day of February 2018, by the following vote:
