ROLL CALL Present: Mayor Rob Rennie, Vice Mayor Steve Leonardis, Council Member Marcia Jensen, Council Member Marico Sayoc, Council Member Barbara Spector. Absent: None PLEDGE OF ALLEGIANCE Mayor Rennie led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Rennie presented commendations to outgoing Commissioners. Mayor Rennie presented a commendation to Art Docents of Los Gatos. Julie Ferrario, President, thanked the Town, spoke about the program, and introduced the Board Members and volunteers in attendance. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session on January 9, 2018 as duly noted on the agenda and there is no report. COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Barbara Spector stated she met with members of the community. - Council Member Marico Sayoc stated she and Mayor Rennie attended the Cities Association meeting and the Silicon Valley @Home Roundtable. - Mayor Rob Rennie stated he attended the swearing in ceremony for the new Los Gatos- Monte Sereno Police Officer, the Valley Transportation Association (VTA) Board meeting, the Silicon Valley Clean Energy Authority (SVCEA) Risk Oversight Committee meeting, the SVCEA Board meeting, and the VTA Policy Advisory Committee meeting. - Vice Mayor Steve Leonardis stated he attended the West Valley Sanitation District (WVSD) Board of Directors meeting and the Treatment Plant Advisory meeting. - Council Member Marcia Jensen stated she had nothing to report. Annexation Application AN17-001. Project Location: 14915 Shannon Road. Applicant/Property Owner: Ray M. Elam III, Trustee Et al. Adopt a Resolution to make determinations and approve the reorganization of an uninhabited area designates as Shannon Road No. 27, approximately 28.61 acres on property pre-zoned RC. APN 537-27-047. RESOLUTION 2018-002 8. Authorize the Town Manager to execute a Certificate of Acceptance and Not ice of Completion accepting the work of Devcon Construction for improvements in the public right of way for 90-160 Albright Way and 14600 Winchester Boulevard and authorize recordi ng by the Clerk Administrator. 9. Zone Change Application Z-17-002. Project Location: 202 University Avenue. Property Owner: Barry and Lisa Cheskin. Applicant: Bess Wiersema. Adopt an ordinance rezoning a property located at 202 University Avenue from O:LHP (Office with a Landmark and Historic Preservation Overlay) to R-1D:LHP (Single-Family Residential Downtown with a Landmark and Historic Preservation Overlay). APN 529-04- 001. ORDINANCE 2268 10. Designate the Town’s agents by title to obtain federal and/or state financial assistance through the California Governor’s Office of Emergency Services (Cal OES). MOTION: Motion by Council Member Marcia Jensen to approve the Consent Items. Seconded by Vice Mayor Steve Leonardis. VOTE: Motion passed unanimously. PAGE 3 OF 10 SUBJECT: DRAFT MINUTES OF THE TOWN COUNCIL MEETING OF JANUARY 16, 2018 DATE: JANUARY 17, 2018 VERBAL COMMUNICATIONS Catherine Somers, Los Gatos Chamber of Commerce Executive Director - Thanked Town staff for assisting in hanging the wreaths downtown, made suggestions for future budget talks, commented on the state of the downtown sidewalks, and suggested a promotion of the fountain at Town Plaza Park. Woody Nedom - Stated he sent an email to Council regarding a suggestion for traffic abatement on Lark approaching Los Gatos Blvd. PUBLIC HEARINGS 11. Conduct a public hearing to consider objections to the Abatement List and order abatement of hazardous vegetation (weeds). Matt Morley, Parks and Public Works Director , presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Marcia Jensen to order the abatement of hazardous vegetation (weeds). Seconded by Vice Mayor Steve Leonardis. VOTE: Motion passed unanimously. 12. Consideration and Introduction of an Ordinance of the Town of Los Gatos amending Section 2.20.025 of the Town Code to increase Town Council salaries from $200 per month to $570 per month, effective January 1, 2019. Robert Schultz, Town Attorney, presented the staff report. Opened Public Comment. Jak Van Nada - Commented in support of the ordinance. Closed Public Comment. Council discussed the matter. Seconded by Council Member Marico Sayoc. VOTE: Motion passed 4/1. Council Member Marcia Jensen voting no. The Clerk Administrator read the title of the ordinance. 13. Town Code Amendment Application A-17-003. Project Location: Town Wide: Town of Los Gatos. Consider Amendments to Chapter 29 (Zoning Regulat ions) of the Town Code regarding Accessory Dwelling Units. Sally Zarnowitz, Planning Manager, presented the staff report. Opened Public Comment. Jeff Loughridge - Put forth several questions, asked that the answers be provided to Council, and suggested modifications to the table contained in the draft ordinance. Bob Hencken - Commented on the proposed ordinance. Sara Thomas - Commented in support of the ordinance. Paul Prouty - Commented in support of the ordinance. Bill Hirschman - Provided suggestions for Council discussion on two story versus one story accessory dwelling units (ADU). Chris Diane Wiley - Suggested a count of ADU's be done and to consider parking in relation to ADU’s. MOTION: Motion by Council Member Marcia Jensen to adopt all proposed changes with the addition of: 1) use the wording "on property where dwelling unit exists"; 2) add "standards" after floor area in paragraph 6 of 29.10.320; 3) allow exterior staircases with no restrictions; 4) limit ADU's in the hillsides to one story; 5) eliminate the table on page 7. Seconded by Council Member Barbara Spector. VOTE: Motion passed unanimously. The Clerk Administrator read the title of the ordinance. 14. Adopt a resolution approving amendments to the North 40 Specific Plan. Pete Siemens - Commented that “should” be replaced with “shall,” and the amendment should incorporate how it will meet the required open space. Ed Morimoto - Requested that Council consider increasing residential by 25% to the EIR allowance and reducing the commercial to 435,000 square feet. Don Capobres - Commented on the proposed amendments. Sandy Decker - Commented on the proposed amendments. Susan Buxton - Commented on the use of “should” and “shall” in the Specific Plan. Recess at 10:13 p.m. Reconvened at 10:22 p.m. MOTION: Motion by Mayor Rob Rennie to continue to a date certain of February 6, 2018 and direct staff to provide further information on economic data, park space in exchange for height on a hotel, CUP’s consistent with downtown, different traffic scenarios with the limiting factors on the various use combinations, increased housing, options to do innovative uses, and BMP impacts. Approve the Council Policy Committee's recommendations to rescind Resolution 1994 -79 and adopt a policy for the placement of street pole banners and seasonal decorations affixed to Town infrastructure and located in the public right -of-way.
