090, 094 THROUGH 096, 099, 100, 102 THROUGH 112, 424-06-115, 116,

REMARKS:
Exhibit A of Attachment 11 contains all of the instances where “should” appears in North 40
Specific Plan. The General Plan Committee recommended that all references to “should” be
changed to “shall” to create additional objective standards that reinforce the Vision and
Guiding Principles of the Specific Plan. Staff has reviewed Exhibit A of Attachment 11 and does
not recommend that “should” be replaced with “shall” in any of the instances in the Specific
Plan because it will not result in additional meaningful objective standards.
Alternatively, the Council could direct staff to change all of the instances of “should” to “shall.”
If the Council determines that this is more appropriate, then staff would make those changes
throughout the Specific Plan except for in the following instance:
Policy LU8: Hotel/Conference Facilities
A hotel facility developed within the North 40 Specific Plan Area should include a
conference/meeting space to accommodate 200 to 250 people.

Staff is not recommending that this instance be changed because requiring a hotel to contain
conference/meeting space to accommodate 200 to 250 people severely limits the type of hotel
that can be proposed.

the staff report.
