ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK OF
DEVCON CONSTRUCTION FOR IMPROVEMENTS IN THE PUBLIC RIGHT OF
WAY FOR 90-160 ALBRIGHT WAY AND 14600 WINCHESTER BOULEVARD
AND AUTHORIZE RECORDING BY THE CLERK ADMINISTRATOR
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
(Attachment 1) accepting the completed work of Devcon Construction for improvements in the
public right of way for 90-160 Albright Way and 14600 Winchester Boulevard and authorize
recording by the Clerk Administrator.
BACKGROUND:
The Town Council adopted Ordinance 2216 on June 17, 2013, approving Planned Development
application PD-12-001. Ordinance 2216 modified the existing Planned Development to allow
for redevelopment of the existing site with up to 485,000 square feet of new office/research
and development buildings and approval to construct the improvements represented in the
Planned Development as listed in Ordinance 2216.
DISCUSSION:
The developer, LG Business Park LLC, was required to provide the required contracts, bonds,
and liability insurance to guarantee the construction of all improvements. The developer has

DISCUSSION (cont’d):
paid the appropriate fees to fully comply with the previously imposed development conditions
and Town ordinances.
The developer was required to complete the following public improvements:
1. Construct and install a new intersection aligned with the existing Courtside driveway on
Winchester Boulevard.
2. Construct and install of a full traffic signal, signal interconnection , and associated timing
coordination prior to issuance of the first certificate of occupancy.
3. Provide interconnection, coordination, and timing of the additional traffic signals along
Winchester Boulevard from the new project signal to signals at Wimbledon Drive,
Lark/Winchester, and Lark/University.
4. Install Class II bike lanes in both the northbound and southbound directions on
Winchester Boulevard between Wimbledon Drive and the rail crossing.
5. Widen Winchester Boulevard to provide dedicated right turn lanes at the south entry
and a new signalized entry.
6. Restripe southbound Winchester Boulevard between the Courtside entrance and Lark
Avenue to provide a dedicated southbound left-turn lane to eastbound Lark Avenue.
7. Construct and install a bus pad along northbound Winchester Boulevard north of
Albright Way.
The developer has completed all the required work to the satisfaction of the Town and the
project is ready for acceptance by the Town.
The developer posted security in the form of bonds to ensure that the public improvements
would be constructed to Town standards. The Town releases 90 percent of the security upon
recordation of the Certificate of Acceptance and Notice of Completion, and retains 10 percent
for one year.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate
of Acceptance and Notice of Completion accepting the completed work of Devcon Construction
for improvements in the public right of way for 90-160 Albright Way and 14600 Winchester
Boulevard and authorize recording by the Clerk Administrator.

FISCAL IMPACT:
There is no direct known fiscal impact associated with accepting these previously required
public improvements. Once accepted, these improvements become part of the Town’s
infrastructure which must be maintained.
ENVIRONMENTAL ASSESSMENT:
An Environmental Impact Report (EIR) was previously prepared for the project as required by
the California Environmental Quality Act (CEQA). The Environmental Impact Report was
certified and the Mitigation Monitoring and Reporting Program adopted by Town Council on
June 3, 2013.
