The undersigned individuals owning property served by the public alleys located in the 200 block of Wilder, Tait
and Massol Avenues request the Town Council to adopt the following position regarding the improvement and
maintenance of the above referenced alleys.
1 Formall3Accept Dedication of alley right of way
The Town Staff completed research verifying that the alleys are not owned by adjoining property owners and
that the town is the defacto owner by virtue of long standing public use and sporadic maintenance activities.
We request that the Town officially "accept" the right of ways.
2. Improvement standards
We request that the town improve the alleys based upon the following standards:
a. The sub pavement and pavement be of adequate strength to support expected heavy truck traffic
including fire and trash vehicles.
b. The alleys should be designed to direct storm runoff to public streets.
c. The improvement contractor can enter into private agreements with adjoining property owners to
make on site improvements such as driveway aprons and parking spaces at the same time as the alley
improvements take place.
d. The appearance of the alley should be similar to the improvements in the alleys serving the 100 block;
of Wilder, Tait and Massol Avenues.
3. Maintenance
We request that the Town maintain the alleyways using the same standards as other public streets.

RECOMMENDATION:
Consider a progress report on the proposed assumption of maintenance of alleys.
BACKGROUND:
Two staff reports have been submitted to Council concerning the Town assuming the maintenance
of alleys. At the meeting of July 2, 2001, the Town Council directed staff to address specific
questions regarding alley maintenance and "ownership." The Town Council also directed staff to
meet with residents along alleys to ascertain what accommodation could be made to meet their
preferences within certain legal and engineering parameters.
Subsequently, staff held a meeting on August 30, 2001 which was attended by seventeen citizens,
some of whom stated that they represented their neighborhood. At this meeting, staffpresented legal
and engineering parameters in which alleys would be improved and maintained presuming the Town
assumed that responsibility.
At the meeting of September 13, 2001, the Town Council discussion addressed maintaining alleys
on an individual basis with neighborhood input for each alley. The Town Attorney also reconfirmed
that once the Town maintains an alley it becomes public property by informal acceptance. Council
directed staff to obtain additional input from citizens, further refine the policy and it's
implementation and report back.

DISCUSSION:
This is a progress report on the proposed assumption of maintenance responsibility for alleys. As
discussed below, engineering staff has devised a method for determining the appropriate design
standards and specifications for improving each alley, which would also provide the basis of a more
accurate measure of the long term cost of maintenance. While this matter was noticed as a public
hearing, it may not be the final hearing. For purposes of obtaining public comments on the design
standards and specifications, a hearing could occur when staff recommends standards and
specifications for each alley, and then after the adjacent neighbors have been provided notice of that
hearing. Staff anticipates that this could occur by June 15, 2002.
Most of the residents who live adjacent to the alleys are in favor of the Town assuming the
maintenance of alleys, and have indicated interest in having the standard similar to local streets. The
use of alleys is mainly by the local residents and utility companies, with the exception of Victory
Lane in downtown that delivery trucks also use. The alleys where residents do not favor the Town
assuming maintenance is the alley behind Glenridge, between Bachman and Ellenwood, and the alley
between Johnson and Loma Alta above Reedhead Lane. (Attachment 1)
The alleys vary significantly in their improvement needs. This is in part because the alleys have
received various levels of improvement over the past century; no two alleys are alike. Some are
similar, yet each one's condition and improvement needs vary. Additionally, not all alleys have the
same infrastructure benefits, such as storm drains. Because of this, staff recommends having
standards that are driven by drainage, loads, and stone water discharge as well as the residents'
interests.
A variety of unique conditions exist in each alley that staff consider in need of further analysis, in
order to determine each alley's standard of improvement. For instance, some alleys have no
adjacent storm drains for gutter runoff, so a different standard of improvement will be necessary,
such as crushed compacted gravel for drainage. Load and width considerations should also drive the
individual alley's improvement plan, as two -axel vehicles will stress and potentially damage
pavement. Also, mature trees have narrowed sections of some alleys. Storm water runoff that is
currently absorbed by the soil may be determined best to continue in this manner in certain locations.
As each alley has unique features, immediate data collection that includes coring and surveying will
be necessary to enable staff to determine each alley's specific improvement plan.
A table of characteristics with a description of each alley and it's improvement needs and estimated
costs are attached. (Attachment 2) Engineering staff determined these cost estimates based on each
alley's condition and improvement needs. Additional data will confirm or adjust these cost
estimates. Once the additional coring and survey data is gathered and analyzed, staff will then
finalize each alley's improvement plan, appropriate costs, and develop an alley improvement
schedule. Should Council determine after anticipated future public hearings to accept all or some of
the alleys, these improvement plans would need to be incorporated into the ongoing Capital
Improvement Street Resurfacing Program.

CONCLUSION:
Staff recommends having alley improvement standards that are driven by certain criteria including
drainage, loads, storm water discharge and the adjacent residents' interests. Staff will prepare
preliminary designs and a work plan to upgrade alleys in anticipation of the final public hearing on
the question of whether to accept the alleys for maintenance. When an alley upgrade has been
completed, the Town will become responsible for its maintenance. However, where concurrence
with affected residents has not been reached regarding alley upgrades, Council may decide not to
assume maintenance of alleys.
Next Steps:
1. Include proposed alley improvements in 2002 -03 Capital Improvement Program for approval by
Town Council.
2. Meet with adjacent property owners to present proposed alley improvements.
3. Prepare plans and specifications for all alleys where property owners have agreed with staff on
improvements.
4. Present the plans, specifications, and estimate to Town Council after action is taken on approval
of the Capital Improvement Program budget.
ENVIRONMENTAL ASSESSMENT:
Is a project as defined under CEQA, but is categorically exempt under 15301(c). A Notice of
Exemption will not be filed.
FISCAL IMPACT:
The cost to collect coring and surveying data will be approximately $15,000. After this initial
expense, there will be a specific cost associated with upgrading each individual alley, due to their
unique improvement needs. The current cost estimate to improve the alleys has been re- evaluated
as $219,000, slightly higher than previously reported to Council, as additional improvement needs
have been identified. Once the coring and survey data are received, staff will be able to accurately
determine the cost to improve each alley. The estimates of these costs will then be reflected in the
proposed Capital Improvement Program from RDA funds as appropriate. Any alley improvements
outside of the redevelopment area would be funded by appropriate sources. The future maintenance
of the alleys will be drawn from street maintenance funds and gas tax allocation to the Town.

Motion by Mr. Pirzynski, seconded by Mrs. Decker, that Council make the Findings as expressed
in Attachment 1, showing consistency with the General Plan and Hillside Plan; giving community
benefit outweighing traffic impacts and following Town's in -fill policy. Carried unanimously.
The Town Clerk read the Title of the Proposed Ordinance.
Motion by Mr. Glickman, seconded by Mrs. Decker, to waive the reading of the Proposed
Ordinance. Carried unanimously.
Motion by Mr. Glickman, seconded by M_ rs. Decker, that Council introduce Ordinance
to include the following mendments: 1 Lawn area to cover no more than 5, u ; V
g ) 000 square feet;
2) Privacy fencing shall be determined during Architecture and Site approval and any modification
of that fencing must return to A &S; 3) A home may be constructed on Lot 14 following replacement
guidelines addressing size, mass and scale in relation to the original home destroyed by fire. This lot
will also keep the roadway to a minimum and shield the road with landscaping; 4) The entrance to
the project will be evaluated by the Parks and Public Works Department for vehicular safety. A cut-
off style, shielded light is allowed only if there is no other feasible way to ensure that vehicular safety
can be provided. 5) Council requested articulation of design in relation to the height of the homes.
Carried unanimously.
PROPOSED ASSUMPTION OF ALLEY MAINTENANCE (22.23)
Mayor Attaway announced that this was the time and place so noted for public hearing to consider
the Town assuming maintenance of alleys under specific conditions.
Mr. Curtis, Public Works Director, gave report on the ongoing activities regarding the maintenance
of Town alleys and noted that these projects would come forward in the CIP. and the Budget hearings.
Once in the 2002 -2003 Budget, the actual projects will be brought back to Council, with action
recommended, so as to be able to bring these alleys up to certain standards before the Town maintains
them.
The following people from the audience addressed this issue:
Nayan McNeill, 225 Johnson Ave, spoke concerning the maintenance of her alley and possibly
vacating the portion of the alley closest to her home.
Julie Gilbert, 243 Bachman Ave, asked for Town to accept the maintenance of her alley and noted
the redevelopment monies that were designated for blighted areas specified in that program
Tim Coughlin, 233 N. Santa Cruz Ave, supported Town's maintenance of Victory Lane.
Bob Cowan, 222 Tait Ave, spoke of the drainage problem on his alley and noted that his neighbors
were ready for any improvements.
Jeff Seders, 178 Loma Alta Ave, supported the Town's maintenance of the alleys.
Gary Garton, 172 Loma Alta, asked for Town's maintenance of the alley he is obliged to drive on
in order to park his car as required by the Town when he made some home improvements.
Diane Hunt, 132 Loma Alta Ave, favored the Town maintaining the alleys.
No one else from the audience spoke to the issue.
Motion by Mr. Glickman, seconded by Mrs. Decker, to close the public hearing. Carried
unanimously.
Motion by Mrs. Decker, seconded by Mr. Blanton, that Council accept and file the progress report
on the proposed assumption of maintenance of alleys. Carried unanimously.
