RECITALS
Town and Service Provider entered into an Agreement for Services on April 9,2014
("Agreement"), a copy of which is attached hereto and incorporated by reference as
Exhibit A to this Amendment, to provide park tree pruning services.
Town and Service Provider entered into a First Amendment to Agreement for Services on
April 5, 2016 ("Agreement"), a copy of which is attached hereto and incorporated by
reference as Exhibit B to this Amendment.
Per Council action on April 7, 2014 to approve the original agreement with West Coast
Arborists, the Town Manager retains the ability to extend the agreement in the amount of
$ 100,000 annually, for up to two years (to June 30, 2018), based on budget availability.
Town desires to amend the Agreement to extend the Term of the agreement for one
additional year (to June 30, 2017), and to incorporate a revised Schedule of
Compensation for tree maintenance services, based on the State of California Department
of Industrial Relations predetermined increase for prevailing wage rate.
AMENDMENT
l. Section 2.2 Term and Time of Performance: The term of the agreement is extended
through June 30, 2017, based on Town Council budget appropriations for the scope of
services.
2. eqmpensation is amended to read as follows: Compensation for services for the period
JufV 1, 2016 through June 30,2017 shall not exceed $100,000, incorporating the revised
Schedule of Compensation for Tree Maintenance Services, which is hereby incorporated
by reference and attached as Attachment l.
3. All other terms and conditions of the Agreement remain in full force and effect.
