SUBJECT: AUTHORIZE THE TOWN MANAGER TO NEGOTIATE AND EXECUTE A
MUNICIPAL SERVICES AGREEMENT AND ANY FUTURE AMENDMENTS
WITH THE CITY OF MONTE SERENO
RECOMMENDATION:
Authorize the Town Manager to negotiate and execute a Municipal Services Agreement
(Attachment 1) and any future amendments with the City of Monte Sereno.
BACKGROUND:
The City of Monte Sereno has limited staffing with no field staff able to address urgent
operational needs. The Town often receives calls for service through the Los Gatos-Monte
Sereno Police Department (LGMSPD) Dispatch Center. The irregular border between Los
Gatos and Monte Sereno can make it difficult to determine the responsible jurisdiction,
especially during urgent or emergency situations.
DISCUSSION:
Town staff has worked with the City of Monte Sereno to develop a Municipal Services
Agreement that identifies a method for Town staff to assist with urgent needs within Monte
Sereno. The agreement developed largely due to experiences from last winter’s heavy storms
and situations where Los Gatos had crews working or on standby that could readily respond to
the needs, while at the same time Monte Sereno had difficulty finding contractors to respond .
In addition, Town staff has, at times, arrived at the site of a concern, only to find that the
location was in Monte Sereno. Other times the need has been within Monte Sereno and the
Town has been positioned to respond but with no authority to do so.

DISCUSSION (cont’d):
The agreement allows for Town staff to respond to needs within Monte Sereno. Monte Sereno
has committed to reimbursing the Town for staff costs associated with the work. The
agreement acknowledges that Town needs remain a priority and the Town has the ability to
exit the agreement at any time.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to negotiate and
execute a Municipal Services Agreement and any future amendments with the City of Monte
Sereno. The execution of a Municipal Services Agreement will continue a strong partnership in
service delivery between the Town and Monte Sereno.
COORDINATION:
This report has been coordinated with the Town Attorney.
FISCAL IMPACT:
The Town will incur moderate operating expenses offset by equivalent revenue in relation to
this agreement.
ENVIRONMENTAL ASSESSMENT:
This is not a project defined under CEQA, and no further action is required.
