Main Street Los Gatos, CA 95030 ● 408-354-6832 www.losgatosca.gov TOWN OF LOS GATOS COUNCIL AGENDA REPORT MEETING DATE: 4/18/2017 ITEM NO: 9 DATE: APRIL 4, 2017 TO: MAYOR AND TOWN COUNCIL FROM: LAUREL PREVETTI, TOWN MANAGER SUBJECT: ADOPT A RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE ALL APPLICATIONS, AGREEMENTS, AND ANNUAL REPORTS FOR THE PURPOSE OF SECURING BEVERAGE CONTAINER RECYCLING CITY/COUNTY PAYMENT PROGRAM FUNDS OFFERED BY THE STATE OF CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY (CALRECYCLE) IN ORDER TO IMPLEMENT NEW OR ENHANCE EXISTING PROGRAMS TO CLEAN UP THE WASTE STREAM RECOMMENDATION: Adopt a resolution (Attachment 1) authorizing the Town Manager to execute all applications, agreements, and annual reports for the purpose of securing Beverage Container Recycling City/County Payment Program funds offered by the Department of Resources Recycling and Recovery (CalRecycle) in order to implement new or enhance existing programs to clean up the waste stream. BACKGROUND: In 1987, the California Beverage Container and Litter Reduction Act (Act) was implemented to encourage recycling and reduce litter. CalRecycle administers the Beverage Container Recycling Grant and Payment Program for the State of California and distributes payments each year to cities to promote beverage container recycling and litter reduction activities. Each city is eligible to receive a minimum of $5,000 or an amount calculated by CalRecycle, on a per capita basis, whichever is greater. The program is designed to promote increased recycling and reduce litter in the waste stream. The Town has benefited in the past from the annual payment programs, which is based on a per capita calculation and averages approximately $8,000 annually. PAGE 2 OF 2 SUBJECT: ADOPT A RESOLUTION AUTHORIZING THE TOWN MANAGER TO EXECUTE ALL APPLICATIONS, AGREEMENTS AND ANNUAL REPORTS FOR THE PURPOSE OF SECURING BEVERAGE CONTAINER RECYCLING CITY/COUNTY PAYMENT PROGRAM FUNDS APRIL 4, 2017 S:\COUNCIL REPORTS\2017\04-18-17\CalRecyle\Staff Report FINAL.docx 4/12/2017 2:43 PM SH BACKGROUND (cont’d): Beginning in the Fiscal Year 2015/16 funding cycle, CalRecycle began to require all jurisdictions to adopt a resolution which would authorize the jurisdictions to apply for and collect funds under the Beverage Container Recycling City/County Payment Program. Prior to this year, the only action required by jurisdictions to receive their payment was to submit a funding request through CalRecycle’s online portal. In order for the Town to continue receiving funding, adoption of a resolution acknowledging CalRecycle’s Beverage Container Recycling City/County Payment Program must be submitted to the California Department of Resources Recycling and Recovery. DISCUSSION: CalRecycle’s goal for the Beverage Container Recycling City/County Payment program is to reach and maintain an 80 percent recycling rate for all California Refund Value (CRV) beverage containers - aluminum, glass, plastic and bi-metal. Projects implemented by the Town would assist the State in reaching and maintaining the 80 percent goal and may include recycling containers, litter cleanup, and education and outreach. The attached resolution recognizes the Town’s participation in the Beverage Container Recycling City/County Payment Program. Following adoption of the resolution, the Town will be eligible to continue receiving annual funding from the State. FISCAL IMPACT: The Town will receive approximately $8,000 to assist the State in reaching and maintain an 80 percent recycling rate for all CRV beverage containers. ENVIRONMENTAL ASSESSMENT: This is not a project defined under CEQA, and no further action is required. Attachment: 1.
