SUBJECT: ADOPT A RESOLUTION APPROVING THE COUNCIL POLICY COMMITTEE
RECOMMENDATIONS FOR THE MODIFICATION OF THE TRAFFIC IMPACT POLICY
REMARKS:
After the distribution of the staff report, staff received the following question from a Council
Member:
When the Town Council considered the Policy Committee’s recommendation for an 18-month
pilot period waiving formula retail restrictions and Ordinance 2021, didn’t they also send it back
asking the Policy Committee to look at traffic impact fee modifications?
Yes, the Council did ask the Policy Committee to look at traffic impact fee modifications.
Specifically, on March 15, 2016, the Town Council considered an 18-month suspension of the
Formula Retail restrictions and the language in section one of Ordinance 2021, strongly
discouraging retail spaces from becoming a restaurant use in downtown. After quite a bit of
discussion the following motions were made:
MOTION: Motion by Vice Mayor Marico Sayoc to adopt a resolution to suspend the
requirement for formula retailers to obtain a Conditional Use Permit (CUP). The motion was
seconded by Council Member Marcia Jensen. The motion failed 2/3 (Mayor Barbara Spector
and Council Members Steve Leonardis and Rob Rennie voting no ).
MOTION: Motion by Council Member Rob Rennie to change the ordinance so that formula
retail CUPs go to Development Review Committee only and do not need to go to Planning
Commission. The motion failed for lack of a second.

REMARKS (cont’d):
MOTION: Motion by Council Member Steve Leonardis to return the matter to the Policy
Committee to consider reduction in time, fees, and traffic impact fees. The motion was
seconded by Mayor Barbara Spector and it passed unanimously.
