Staff ReportDRAFT Town Council Meeting 10 /18 /16 Item #2 MINUTES OF THE TOWN COUNCIL MEETING OCTOBER 4 , 201 6 The Town Council of the Town of Los Gatos conducted a Special Meeting on Tuesday , October 4 , 201 6 , to hold a Closed Session at 5:30 p.m. and a Regular Meeting at 7:00 p.m. CLOSED SESSION – 5:30 P.M. CS -1 CONFERENCE WITH LABOR NEGOTIATOR To meet with Town Negotiators listed below in closed session pursuant to Government Code §54957.6 regarding negotiations with the Employee Organizations listed below: Town Negotiators (Lead): Allyson Hauck, Renne, Sloan, Holtzman, Sakai LLP Laurel Prevetti, Town Manager Employee Organizations: Town Employees’ Association (TEA) American Federation of State County a nd Municipal Employees Local No. 101 (AFSCME) Police Officers’ Association (POA) CS -2 TOWN MANAGER EVALUATION (Performance Only) MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Barbara Spector , Vice Mayor Marico Sayoc , Council Member Marcia Jensen, Council Member Steve Leonardis , Council Member Rob Rennie. Absent: None PLEDGE OF ALLEGIANCE Mayor Spector led the Pledge of Allegiance. The audience was invited to participate. CLOSED SESSION REPORT Robert Schultz, Tow n Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Marcia Jensen stated she attended the H igh w a y 85 A dvisory Committee meeting and the Council Policy Committee meeting, and read at preschool story time at the L ibrary. - Council Member Rob Rennie stated he attended the S ilicon V alley C lean E nergy A uthority Executive Committee meeting , and the ribbon cutting for the Gallery 2 4 opening . 2 Town Council/Parking Authority October 4 , 201 6 Council Matter s – continued - Mayor Barbara Spector stated she attended the unveiling of the award in the name o f Pat O'Laug h lin which will be presented to the Town after the Irish L iterary event, the rib b on cuttin g f o r Gallery 2 4, she and Vice Mayor Sayoc attended the multicultural e v ent at the T erraces, and she, Vice Mayor Sayoc, and Council Member Jensen attended the Y outh Park D ay . - Vice Mayor Marico Sayoc stated she attended the S enior O fficials W orkshop, the L e a gue of California C ities quarterly meeting, the B oys Team C harities A nnual meeting, S creen on the G reen, and the Council P olicy C ommittee meeting. - Council Me mber Steve Leonardis stated he had nothing to report. Manager Matters - Announced the annual recruitment for adult C ommissioners for all Boards, Commissions, and Committees has begun. The deadline to apply is November 18, 2016, 5 p.m. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council minutes of September 20, 2016 . 2. Authorize the Town Manager to award and execute a construction ag reement (Attachment 1) with California Roofing Co., Inc. in an amount not to exceed $59,019, plus a fifteen percent contingency for a total contract amount not to exceed $67,872 for the Civic Center Museum Roof Improvements Project 821 -2109 . 3. BLOSSOM HILL PARK BACKSTOP REPLACEMENT PROJECT 831 -3407 1. Authorize the Town Manager to award and execute a construction agreement with AAA Fence Company (Attachment 1) in the amount of $91,392, plus a ten percent contingency for a total contract amount not to exceed $10 0,531 for the Blossom Hill Park Backstop Replacement Project 831 -3407. 2. Authorize the Town Manager to accept a one -time donation of $25,000 from the Los Gatos Little League (LGLL) as a contribution t owards the backstop replacement. 4. Authorize the Town Manage r to execute a Third Amendment to Agreement providing for implementation of the Santa Clara Valley Urban Runo ff Pollution Prevention Program. 5. Adopt a resolution making determinations and approving the reorganization of territory designated as Winterbrook R oad No. 5, an approximately 0.394 acre parcel including a section of roadway, located at 16020 Wi nterbrook Road. APN 523 -26 - 014. RESOLUTION 2016 -050 6. Authorize the Town Manager to Purchase Three Replacement Patrol Vehicles from Folsom Lake Ford in an Amou nt Not to Exceed $101,523. 3 Town Council/Parking Authority October 4 , 201 6 Consent Items – continued 7. Storm Maintenance and Response Service Agreement with West Valley Sanitation District a. Authorize the Town Manager to execute a second amendment to Storm Maintenance and Response Service Agreement with West Valley Sanitation District for Storm Drain Maintenance services for FY 2016/17 in an amount not to exceed $43,000. b. Authorize the Town Manager to execute all future amendments to the storm maintenance and response service agreement with West Valle y Sanitation District for storm drain maintenance services including annual rate increases, subject to the annual appropriation of funds by the Town Council. MOTION: Motion by Council Member Marcia Jensen to approve the Consent Items. Se conded by Mayor Barbara Spector . VOTE : Motion passed unanimously . VERBAL COMMUNICATIONS Maria Ristow, represe nting the Broadway neighborhood - T hanked the Town , staff, and contractors for the care and concern given to the residents during the Almond Grove reconstruction. Mike Brown - C ommented on the Hilow project that was before Council on September 20 . PUBLIC HEARINGS 8. Consider amendments to section 29.10.150 of Chapter 29 of the Los Gatos Town Code to revise the required parking requirements for restaurants . Monica Renn, Economic Vitality Manager, and Joel Paulson, Community Development Director, presented the staff report. Opened Public Comment . Alex Hult - C ommented in favor of the F ire C ode dictating the number of seats , decoupling seats and parking, staying with the 300 s quare f oot calculation, looking into creative ways to help with the parking ; and he was against increasing the parking space requirement s . M OTION: Motion by Council Member Marcia Jensen to not take action on the ordinance tonight, and to return the question along with a comprehensive look at parking to the P olicy Committee . Se conded by Council Member Steve Leonardis . VOTE : Motion passed unanimously . OTHER BUSINESS 9. Receive a status report on the Entertainment Policy adopted by Town Council on June 21, 2016 Robert Schultz, Town Attorney, presented the staff report. Opened Public Comment. Michael Verga - C ommented that the outdoor entertainment by right policy should be eliminated . Alex Hult - Commented in favor of the existing policy. Gillian Verga - M ade suggestions for modifications to the existing policy . Catherine Somers - Commented in support of the existing policy. Steve Hauck - Q uestioned the process and cost for those who have a limitation in their Conditional Use Permit (CUP ) as opposed to those businesses with no limitations in their CUP s . Closed Public Comment. Council discussed the matter and no action was taken . 5 Town Council/Parking Authority October 4 , 201 6 10. Author ize the Town Manager to send a letter to the Metropolitan Transportation Commission and the Association of Bay Area Governments in support of the preferred scenario for Plan Bay Area 2040 . Laurel Prevetti, Town Manager, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Marcia Jensen to send a letter to the Metropolitan Transportation Commission and the Association of Bay Area Governments in support of the preferred scenari o for Plan Bay Area 2040 with wording that doesn’t contain specific numbers, but where possible in dicate s the Town would support numbers that are consistent with the G eneral P lan projections and planning , and emphasiz es that the Town look s forward to working with them on any future modifications to the plan . Se conded by Mayor Barbara Spector . VOTE : Motion passed unanimously . 11. Discuss and adopt the Policy Committee’s recommendation for a Legislative Policy . POLICY 2 -18 Laurel Prevetti , Town Manager , presented the staff report. Opened and closed Public Comment . Council discussed the matter. MOTION: Motion by Council Member Marcia Jensen to approve the Policy Committee’s recommendation for the Legislative Policy . Se conded by Mayor Barbara Spector . VOTE : Motion passed unanimously .
