SVRIAPREPARED BY: LAUREL PREVETTI Town Manager Reviewed by: N/A Assistant Town Manager Town Attorney Finance C:\Users\slombardo\Downloads\8-16-16_2016.Restated.SVRIA.JPA.SCVTA (2).doc MEETING DATE: 08/16/16 ITEM NO: 2 COUNCIL AGENDA REPORT DATE: AUGUST 11, 2016 TO: MAYOR AND TOWN COUNCIL FROM: LAUREL PREVETTI, TOWN MANAGER SUBJECT: AUTHORIZE THE TOWN MANAGER TO EXECUTE THE RESTATED SILICON VALLEY REGIONAL INTEROPERABILITY AUTHORITY JOINT POWERS AGREEMENT TO ACCOMMODATE SANTA CLARA VALLEY TRANSPORTATION AUTHORITY AS AN ADDITIONAL MEMBER TO THE AUTHORITY RECOMMENDATION: It is recommended that the Town Council authorize the Town Manager to execute the Restated Silicon Valley Regional Interoperability Authority (SVRIA) Joint Powers Agreement (JPA) to accommodate Santa Clara Valley Transportation Authority (VTA) as an additional member to the SVRIA. REMARKS: The Board of Directors of the SVRIA request that the current members of SVRIA approve revisions to the JPA in order to accommodate a new member, the VTA. On August 2, 2016, this item was pulled from the Consent Calendar by a member of the public. After closing the public comment on this item, the Town Council continued this item to the August 16, 2016 Council meeting and requested staff to return with answers to several questions. The questions and responses are below. These responses were coordinated with the Town’s Police Department and with staff from SVRIA. 1. Please clarify the monetary contribution of VTA. According to the draft agreement (Attachment 1 redline and Attachment 2 clean), the VTA pays its proportional share of the infrastructure (or equipment capital costs) and its share of the ongoing operational and maintenance costs. Attachment 3 contains a comparison of each set of costs for all participating agencies with and without VTA. Why is VTA willing to pay so much to be part of this? The payment schedule is based on the number of users of the communication system. If approved, VTA would have the third largest number of users and its proportionate share of the costs of the communication system is $5.5 million over three years and annual operations and maintenance costs in excess of $700,000. 3. What are the implications of VTA having two seats on the SVRIA Board? As stated in Article 5 of the agreement, the Board structure includes two representatives from the City of San Jose and the County of Santa Clara. In addition, the Board includes a representative who is selected from the Cities Association City Selection Committee as an additional Santa Clara County appointee (currently held by a Council Member from the City of Mountain View). All other cities and the Town are in one of four groups with a single representative for each group of cities. If approved, VTA would have one SVRIA Board member who is an elected member of its Board or Policy Committee and the other would be the VTA General Manager or designee (in other words, a staff person). The VTA Board and Policy Committee are made up of elected officials from the County and cities within Santa Clara County. VTA would be the only entity with a staff representative. It is implied in the materials from SVRIA that the number of Board members from an agency is related to the number of users. City of San Jose, the County, and VTA would have the three highest numbers of users of the shared communication system. 4. What is the anticipated cost savings to the Town if VTA joins the SVRIA? As shown in Attachment 3, the Town’s proportionate share of the capital costs are $156,614 without VTA and $127,070 with VTA. In terms of operations and maintenance, the Town would pay approximately $50,000 with VTA and approximately $61,600 without VTA. 5. What are the advantages to the Town of Los Gatos to have VTA as a member of SVRIA? In addition to the expected financial benefits, VTA’s participation with SVRIA is important for overall communications and interoperability between agencies during an incident. Because VTA operates all of the transit services within the cities in Santa Clara County, it is important that public safety and transit entities can communicate with each other during and after a large scale event such as an earthquake.
