CS-1. Absent: None PLEDGE OF ALLEGIANCE Katherine Wales led the Pledge of Allegiance. The audience was invited to participate. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Marcia Jensen stated she had nothing to report. - Council Member Rob Rennie stated he attended the Silicon Valley Clean Energy Authority Executive Committee meeting, the Los Gatos Chamber of Commerce discussion on the S. Santa Cruz Avenue pilot closure, the Silicon Valley Leadership Group Regional Economic Forum with the Town Manager, and Senator Be all’s Fire Safety Workshop. - Mayor Barbara Spector stated she, along with the Mayor of Monte Sereno, presented the Seniors of Distinction Awards at the Terraces; she attended a ribbon cutting for Rastopoulis Farmer's Agency; assisted with the presentation of the award from the State of California at the Small Business Award Ceremony at Hult’s Restaurant; attended the Los Gatos Celebrates the 4th event; she and the Town Manager attended the West Valley Mayor Manager meeting; she attended several Jazz on the Plazz and Music in the Park events; and was a speaker for the Kiwanis lunch meeting. - Vice Mayor Marico Sayoc stated she attended the Bicycle and Pedestrian Advisory Commission (BPAC) Community meeting, and along with Council Member Marcia Jensen she attended the Council Policy Committee meeting. - Council Member Steve Leonardis stated he attended the Small Business Award Ceremony at Hult’s Restaurant. 3 Town Council/Parking Authority August 2, 2016 Manager Matters - Presented the quarterly employee recognition award to the Police Dispatcher Team. Accepting on behalf of the dispatchers were Christine Crosson, Heather Villarica, and Tammy Church. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council minutes of June 21, 2016. 2. Approve Council minutes of June 29, 2016. 3. Approve Fourth Quarter Investment Report (April through June 2016) for Fiscal Year 2015/16. 4. Authorize the Town Manager to execute the Restated Silicon Valley Regional Interoperability Authority Joint Powers Agreement to accommodate Santa Clar a Valley Transportation Authority as an Additional Member to the Authority. 5. Adopt a Resolution to set a date for consideration of a reorganization of an uninhabited area designated as Marchmont Drive No. 4, approximately 0.28 acres located at 16709 Marchmont Drive (APN 532-09-044). File #AN16-004. RESOLUTION 2016-040 6. Accept report on Town Manager approved actions during Council Recess. Item #4 was pulled by Colin Corbett. MOTION: Motion by Council Member Marcia Jensen to approve Consent Items 1-6, exclusive of Item 4. Seconded by Mayor Barbara Spector. VOTE: Motion passed unanimously. Pulled Consent Item #4 4. Council discussed the matter. MOTION: Motion by Council Member Rob Rennie to accept the recommendation in the staff report. Motion failed for lack of a second. 4 Town Council/Parking Authority August 2, 2016 Pulled Consent Item #4 – continued MOTION: Motion by Council Member Steve Leonardis for staff to return to Council before September 1st with information on the funds, the number of seats on the board, and the advantage or disadvantage to Los Gatos by renewing the agreement. Seconded by Council Member Marcia Jensen. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS There were no verbal communications. PUBLIC HEARINGS 7. Consider the 2016 Weed Abatement Program Assessment Report from The County of Santa Clara Consumer And Environmental Protection Agency and Adopt A Resolution Confirming the Report and authorizing collection of the assessment charges. RESOLUTION 2016-041 Matt Morley, Director of Parks and Public Works, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Marcia Jensen to approve the recommendation in the staff report. Seconded by Council Member Steve Leonardis. VOTE: Motion passed unanimously. 8. Architecture and Site Application S-14-056. Project Location: 18151 Overlook Road. Property Owner: Ronald M. Tate. Applicant/Appellant: Urban West, LLC, Nicole King/Lance Tate. Consider an appeal of a Planning Commission decision denying a request to demolish an existing single-family residence, construct a new single- family residence, and obtain a grading permit on property zoned r -1:8. APN 510-40- 146. RESOLUTION 2016-042 Erin Walters, Associate Planner, presented the staff report. MOTION: Motion by Council Member Marcia Jensen to deny the appeal of the Planning Commission and adopt the resolution contained in Attachment 13. Seconded by Mayor Barbara Spector. VOTE: Motion passed unanimously. OTHER BUSINESS 9. Adoption of an Ordinance to Increase Transient Occupancy Tax From 10% to 12% and a Resolution to place a Measure Increasing the Transient Occupancy Tax (T OT) From 10% To 12% on the November 2016 General Election Ballot. MOTION: Motion by Council Member Steve Leonardis to adopt recommendations 1 through 3 in the staff report and the language in the bullet at the bottom of page 3 for the ballot . Direct staff to prepare proposed amendments to the Town Code, General Plan, and other policy documents incorporating the recommendations from the Planned Development Study Committee and forward these proposed amendments to the Planning Commission for consideration. MOTION: Motion by Council Member Marcia Jensen to direct staff to prepare proposed amendments to the Town Code, General Plan, and other policy documents incorporating the recommendations from the Planned Development Study Committee and forward these proposed amendments to the Planning Commission for consideration. Seconded by Council Member Rob Rennie. VOTE: Motion passed unanimously. 11. Receive the report on the pilot closure of a portion of South Santa Cruz Avenue to address cut through traffic, authorize the Town Manager to execute a First Amendment to the Agreement with Traffic Patterns increasing compensation by $32,288 for a total of $57,288, and provide direction on next steps. Council discussed the matter. 8 Town Council/Parking Authority August 2, 2016 Other Business Item #11 – continued MOTION: Motion by Council Member Rob Rennie to continue the pilot program on Saturdays through Labor Day, including Sunday and Monday of Labor Day weekend. Motion failed for lack of a second. MOTION: Motion by Mayor Barbara Spector to continue the pilot program on all Saturdays and Sundays through Labor Day, including Labor Day. Seconded by Council Member Steve Leonardis. VOTE: Motion passed unanimously. MOTION: Motion by Council Member Steve Leonardis to grant staff the budget authority to collect the data and implement the closure by: authorizing the Town Manager to extend the contracts with Statewide and Traffic Patterns to move forward with additional data collection for the five weekends identified in the prior motion; and acknowledging the estimated cost to move forward with the five weekends identified in the first motion of $45,000 for traffic control and an additional $50,000 for data collection by Traffic Patterns, beyond the First Amendment of the agreement with Traffic Patterns, bringing the Traffic Patterns total contract to $107,288. Seconded by Mayor Barbara Spector. VOTE: Motion passed unanimously. MOTION: Motion by Council Member Steve Leonardis to direct staff to bring back information on each of the items on the capital improvements listed in staff's presentation: 1) Permanent Dynamic Messaging Signs, 2) Traffic Signal Timing – Highway 9, 3) Increase Size of Highway 9 On Ramp, 4) Lane Changes at Winchester and Lark, 5) Lane Changes on LGB at Nino, 6) ITS Infrastructure – Origin-Destination Data, and 7) Semi-Permanent Closure of S. Santa Cruz Avenue. Seconded by Council Member Rob Rennie. VOTE: Motion passed unanimously. 12. Approval of Amendment No. 1 to an Agreement with Santa Clara Stadium Authority and City Of Santa Clara for an Additional three years that sets forth terms and conditions under which Town Police Officers may be authorized to work as reserve officers for the City of Santa Clara at Levi Stadium. 9 Town Council/Parking Authority August 2, 2016 Other Business Item #12 – continued Robert Schultz, Town Attorney, presented the staff report. VOTE: Motion passed unanimously. 13. Discuss and adopt the Policy Committee’s recommendation for a Town Facilities Use Policy. POLICY 1-04 Monica Renn, Economic Vitality Manager, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Marcia Jensen to adopt the Policy Committee's recommendation for Town Facility's Use Policy and that information regarding the Library Operating Procedures be distributed to the Council and posted or directed to links on the website.
