An applicant shall be ineligible for a density bonus
… on any property that includes:
• Rental dwelling units which are occupied by lower or
very low income households, or
• If the dwelling units have been vacated or
demolished in the five-year period preceding the
application, have been occupied by lower or very low
income households,
UNLESS the proposed housing development
REPLACES those units…..
“Replace” shall mean either of the
following:
•If occupied – they SHALL provide at least the
same number of units of equivalent size or
type … and made available to persons and
families at the same or lower income level as
the current occupants
•If unoccupied - they SHALL provide at least the
same number of units of equivalent size or
type … and made available to persons and
families .. In same proportion of affordability
as the occupied units

•All current occupants are renters – but there may be
a case that some units are “For Sale”
•I can attest that some of these units are Low-Income
Households and feel confident that many more are, or
have been, as well.
