MinutesDRAFT Town Council Meeting 08/02/16 Item #2 MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY MEETING JUNE 29, 2016 The Town Council of the Town of Los Gatos conducted a Special Meeting on Tuesday, June 29, 2016, to hold a Special Meeting at 6:00 p.m. MEETING CALLED TO ORDER AT 6:00 P.M. ROLL CALL Present: Mayor Barbara Spector, Vice Mayor Marico Sayoc, Council Member Marcia Jensen, Council Member Steve Leonardis, Council Member Rob Rennie (participating remotely) Absent: None PLEDGE OF ALLEGIANCE Mayor Spector led the Pledge of Allegiance. The audience was invited to participate. VERBAL COMMUNICATIONS None OTHER BUSINESS 1. Consider a time extension for Story Poles for the Phase I North Forty Development Applications. APNS: 424-07-024 through 027, 031 through 037, 070, 083 through 086, 090, and 100. Laurel Prevetti, Town Manager, presented the staff report. Opened Public Comment. Roy Moises - Stated he would like the Story Poles to remain up through Planning Commission and Council Meetings pertaining to North 40. Jack Van Nada - Stated he would like the Story Poles to come down. Lucille Weidman - Stated that she would like the Story Poles to remain in place until the application is resolved to ensure there is not any miscommunication to the public that the project has been approved. 2 Town Council/Parking Authority June 29, 2016 Other Busniess Item #1 – continued Barbara Dodson - Stated that she would like the Story Poles to remain in place until the project has been approved or all appeals have been used, so the public will know that the application is still in process. Angelia Doerner - Stated that she would like the Story Poles to remain up until the application is resolved one way or the other. Amy Despars - Stated that she would like the Story Poles to remain up in fai rness to residents who do not get exceptions or extensions, and also for all residents to have the chance to see the mass of this project. Edward Morimoto - Stated that he would like the Story Poles to come down because of the negative impact they have to his business located on the property. Sandy Decker - Stated that she would like the Story Poles to remain in place. Bruce McCombs - Stated that he would like the Story Poles to remain in place until the end of August after the Town Council Meetings. Don Capobres - Representing the North 40 Development Team, stated that 96% of the Story Poles have been up for four months and 100% of the poles have been up for sixty days. He stated that this would affect the businesses located on the property and agreements with tenants. Development team would like all Story Poles to come down. Linda Kapplinger - Stated that she would not like the inability of Mr. Morimoto to tend to his crops be a determining factor in removal of the Story Poles. Rod Teague - Stated that he would like the Story Poles to remain in place for public awareness. Andrew L. Faber - With Berlinger and Cohen representing Grosvenor, stated that the developer has a vested right, has complied with the policy, and the poles have served their purpose. It is his legal opinion that regardless of Council decision, the developer does not have to legally leave the Story Poles up. 3 Town Council/Parking Authority June 29, 2016 Other Business Item #1 - continued Closed Public Comment. Council discussed the matter. MOTION: Motion by Vice Mayor Marico Sayoc to have the Story Poles, with the exception of those eighteen poles detrimental to those living and working in the immediate area, remain in place through September 7th. Motion failed for lack of second. MOTION: Motion by Vice Mayor Marico Sayoc to have the Story Poles, with the exception of those eighteen poles detrimental to those living and working in the immediate area, remain in place through the first Town Council Meeting on August 9th. Motion seconded by Mayor Barbara Spector. VOTE: Motion passed unanimously 2. Report on pilot closure of South Santa Cruz Avenue to address cut through traffic. Matt Morley, Parks and Public Works Director, presented the staff report. Opened Public Comment. Kevin Fellini - Stated that he is in support of continuation of the traffic pilot. Angelia Doerner - Stated that she feels we should relocate the signs around Town to notify people earlier in their commute. She noticed less police calls during this pilot weekend as opposed to Memorial Day weekend. She is in support of continuing the traffic pilot. Ellis Weeker: - Stated that he is in favor of continuation of the traffic pilot. Bruce McCombs - Stated that he is thankful for the effort by Matt Morley and is in favor of continuation of the traffic pilot. Ed Rathman - Stated that his business was down by 50%, feels that unintended consequences should be considered before making final decisions, and that maybe three weekends is not enough to understand the potential consequences. 4 Town Council/Parking Authority June 29, 2016 Other Business Item #2 – continued Patricia Earnstrom - Stated that there should be consideration for traffic as a whole, during the week and weekend. Consider local traffic, enforcement, and ticketing. Linda Kapplinger - Stated that the data shown by Parks and Public Works shows a successful reduction in traffic and increasing signs and change of location could help keep people from building congestion, and she is in support of continuation of the traffic pilot. Jason Farwell - Stated his concern for the businesses downtown and the impact it will have on them. Jan Eric Nordmo - Stated that he spoke with five business owners and heard that there was a challenge for them downtown. Closed Public Comment. Council discussed the matter. Mayor Barbara Spector, Vice Mayor Marico Sayoc, and Council Member Rob Rennie commented in favor of the continuation of the traffic pilot. Council Member Marcia Jensen and Council Member Steve Leonardis commented in opposition to the continuation of the traffic pilot program. The traffic pilot program will continue for the next two weekends as planned.
