RECOMMENDATION: Receive the report and recommendations from the Ad Hoc Citizen Committee, and direct staff to bring forward the following items for Town Council consideration at its August 2, 2016 meeting: 1. Prepare a draft resolution to place a general purpose, half-cent sales tax with a 25-year sunset on the November 2016 General Election ballot. 2. Provide a draft framework for a Citizens Oversight Committee to ensure all tax revenues from a potential revenue measure are spent a manner consistent with the ballot measure. 3. Propose a draft list of capital improvement projects as potential expenditures should the measure be successful BACKGROUND: At its May 31, 2016 meeting, the Ad Hoc Citizen Committee reviewed a presentation which summarized the results of a recent, independent survey of Los Gatos voters regarding potential revenue measure(s) that could provide dedicated funding for Town services and facilities. The survey found that a general purpose, half-cent sales tax with a 25-year sunset for the November 2016 ballot is viable. A quarter-cent sales tax is also feasible. A utility user tax for the November 2016 ballot is not viable. Over 75% of respondents have a favorable opinion of the job the Town is doing to provide public services to the community. The residents’ strongest priorities are repairing roads, improving traffic flow, maintaining 9-1-1 response times, and repairing aging storm drains. The Committee is recommending to the Town Council that it place a general purpose, half-cent sales tax with a 25-year sunset on the November 2016 ballot. The Committee also discussed accountability measures to ensure that, if passed, funds would be spent on needed capital improvement projects. DISCUSSION: Survey Results and Key Findings A phone and internet survey of approximately 400 Town of Los Gatos residents was conducted by Godbe Research in late April/early May. The purpose of the survey was to gauge residents’ interest in creating a dedicated revenue source for the Town; assessing potential voter support for a general sales tax measure to maintain quality of life and small town character; identify the rate and duration at which voters will support a measure; test support for an alternative User Utility Tax measure; and gauge resident perception of whether the Town is doing a good job providing services and managing public funds. A summary of the survey results and the key findings is included as Attachment 1. The key findings from the survey are:  A general purpose half-cent sales tax with a 25 year sunset for a November 2016 ballot is viable.  A User Utility Tax (UTT) for the November 2016 ballot is not viable.  Residents’ strongest priorities are repairing roads, improving traffic flow, maintaining 9-1-1 response times, and repairing aging storm drains.  A 75% favorability rating from residents who think the Town is doing a good job providing services  A 55% favorability rating from residents who think the Town is managing taxpayer dollars effectively  64% total support from residents for a conceptual ½ cent sales tax with a 25-year sunset Ad Hoc Committee Recommendations As a result of the information provided in the survey results, the Committee unanimously recommends that the Town Council consider adopting a resolution to place a general purpose, half-cent sales tax with PAGE 3 MAYOR AND TOWN COUNCIL SUBJECT: RECEIVE THE REPORT AND RECOMMENDATIONS FROM THE AD HOC CITIZEN COMMITTEE DATE: JUNE 16, 2016 DISCUSSION (cont’d): a 25-year sunset on the November 2016 General Election ballot. The Committee does not recommend placing a Transient Occupancy Tax (TOT) measure on the November 2016 ballot at this time, recommending that consideration of a TOT tax measure be re-evaluated the Town Council and considered in time for the November 2018 election. The Committee also recommends that the Council begin to identify and prioritize a capital improvement project list based on the resident priorities highlighted in the survey with an expenditure plan for the funds generated by the sales tax measure. Finally, the Committee recommends that the Town Council direct staff to review best practices and propose a framework for forming a Citizens Oversight Committee, to review annual or semi-annual audits and the expenditure plan for capital improvement projects identified by the Council, should a sales tax ballot measure be placed on the ballot and passed. These accountability measures are consistent with the Town’s fiscally prudent approach to budgeting. Ballot Language Recommendation As stated earlier in the staff report, the survey results show that residents’ strongest priorities are repairing roads, improving traffic flow, maintaining 9-1-1 response times, and repairing aging storm drains. With these priorities in mind, the recommended ballot language as sampled during the survey for a ½ cent sales tax is as follows: To maintain the quality of life and small town character in the Town of Los Gatos by:  fixing potholes, sidewalks and repairing neighborhood and major town streets;  upgrading town parks, playground equipment and restrooms;  upgrading walking, hiking and bike trails;  beautifying downtown,  maintaining town facilities, and  other essential town facilities and services; shall the Town of Los Gatos enact an one-half cent sales tax, providing $4,000,000 annually, for 25 years, with annual audits, independent citizen’s oversight, and all funds spent locally? Potential Regional Sales Tax Measures On June 2, 2016, the Valley Transportation Authority (VTA) Board voted to place a ½ cent sales tax measure on the November 2016 ballot. Several other local jurisdictions including the City of Campbell, the City of Milpitas and the City of Morgan Hill continue to conduct their due diligence in preserving their options for placing a sales tax measure on the November 2016 ballot. PAGE 4 MAYOR AND TOWN COUNCIL SUBJECT: RECEIVE THE REPORT AND RECOMMENDATIONS FROM THE AD HOC CITIZEN COMMITTEE DATE: JUNE 16, 2016 CONCLUSION AND NEXT STEPS: Staff recommends that the Town Council receive the report from the Ad Hoc Citizen Committee and implement the recommendations contained within this report. Upon approval and direction from Council, staff will prepare a draft resolution, a project list, and a recommended framework for a Citizens Oversight Committee for Council consideration at the August 2, 2016 Town Council meeting. Approval of the recommendations provides Town staff with the opportunity to complete the due diligence needed to prepare for further Council deliberation and consideration while preserving the Town Council’s option of placing a sales tax measure on the November ballot. ALTERNATIVES: Alternatively, the Council could choose the following: A. Direct staff to prepare a resolution for a quarter-cent sales tax instead of a half-cent tax. B. Direct staff to prepare a resolution for both a sales tax revenue measure and a TOT measure. C. Direct staff to prepare a resolution for a TOT measure only. D. Provide modified or additional direction regarding this topic. E. Not pursue any revenue measures at this time. COORDINATION: This report was coordinated with the Town Manager’s Office, the Town Attorney’s Office, and the Finance Department. FISCAL IMPACT: Total election costs for the Town for two Council seats and one six-page ballot measure to be placed on the November 2016 General Election ballot is estimated to be approximately $90,511. ENVIRONMENTAL ASSESSMENT: This is not a project defined under CEQA, and no further action is required. Attachments: 1.
