ROLL CALL Present: Mayor Barbara Spector, Vice Mayor Marico Sayoc, Council Member Marcia Jensen, Council Member Steve Leonardis, Council Member Rob Rennie (remote participant). ROLL CALL Present: Mayor Barbara Spector, Vice Mayor Marico Sayoc, Council Member Marcia Jensen, Council Member Steve Leonardis, Council Member Rob Rennie (remote participant). Absent: None PLEDGE OF ALLEGIANCE Walker and Olivia French led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Spector presented the Small Business, Big Applause Commendation to Los Gatos Dog and Cat Hospital. Poetry Contest winners from Fisher Middle School Simone Stout, Samara Stout, and Ivan Hornung read their poems after an introduction by Joanne Talesfore. COMMISSION APPOINTMENT Peter Dominick was appointed to the Arts and Culture Commission. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. 3 Town Council/Parking Authority April 19, 2016 COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Marcia Jensen stated she attended the Council Policy Committee meeting with Vice Mayor Sayoc, and the Valley Transportation Authority (VT A) Policy Advisory Committee. - Council Member Rob Rennie stated he and Vice Mayor Sayoc were sworn in at the Silicon Valley Clean Energy Authority meeting; he attended the Silicon Valley Leadership CEO Business Climate Conference, the Cities Association Legislative Meeting and its regular meeting; and he was appointed as the LAFCO Alternate from the Cities Association. - Mayor Barbara Spector stated she attended the Silicon Valley Leadership Group meeting, the Executive Board meeting of Rinconada, the County Mayors meeting, and the West Valley Mayors/Managers meeting with Town Manager Laurel Prevetti. - Vice Mayor Marico Sayoc stated she had nothing additional to report beyond what was already reported. - Council Member Steve Leonardis stated he attended the West Valley Sanitation District (WVSD) Board of Directors meeting and the Santa Clara County Treatment Plant Advisory meeting. Manager Matters - Invited the Council and public to attend Spring Into Green on Sunday, April 24 from 10 a.m. to 1 p.m. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council minutes of April 5, 2016 2. Adopt a resolution describing improvements and directing preparation of the Town Engineer’s report for Fiscal Year 2016/17 for Landscape and Lighting Assessment Districts No. 1 and 2 3. Authorize an amendment to the lease agreement between the Town of Los Gatos and the Friends of the Los Gatos Public Library to expand the hours of operation of the retail bookstore located at 108 E. Main Street to include public hours from 12 Noon to 5:00 p.m. on Wednesdays beginning April 2016. 4. Adopt an Ordinance of the Town of Los Gatos amending Section 18.60.10 Smoking Regulations to include restrictions on smoking in commercial zoned areas and in multi-unit residences and other miscellaneous edits. (Continuing to May 3, 2016 Council Meeting) MOTION: Motion by Council Member Marcia Jensen to approve the Consent Items and with respect to Item #4 that it be continued to May 3, 2016. Seconded by Vice Mayor Marico Sayoc. VOTE: Motion passed unanimously. 4 Town Council/Parking Authority April 19, 2016 VERBAL COMMUNICATIONS John Shepardson - Commented on traffic in Los Gatos, unfunded pension liabilities, and the police budget. Anne Robinson - Commented on the placement of residential units in the North 40 development in an area adjacent to Highway 17 that is identified as a cancer high risk area in the Environmental Impact Report. Lisa Tule - Commented on the disposition of the Dittos Lane property. Tony Alarcon - Commented on the increase in traffic in Los Gatos. Olga Enciso Smith - Commented on potentially dangerous increase in traffic due to the North 40 development. Markene Smith - Commented on a light rail extension to Vasona. OTHER BUSINESS 5. PPW Job No. 13-31 – Almond Grove Street Rehabilitation Project 411-811-0003 A. Authorize the Town Manager to negotiate and execute an agreement for professional services to complete the design for the remaining eight streets in the Almond Grove Project to Wilsey Ham in an amount not to exceed $809,778, which includes a 10% contingency. B. Authorize the Town Manager to negotiate and execute an agreement for construction design services on a time and material basis to support field design changes for Broadway and Bachman to Wilsey Ham in an amount not to exceed $10,000. Matt Morley, Parks and Public Works Director, presented the staff report. Opened Public Comment. Angelia Doerner - Commented in opposition to the dollar amounts in the design contract, and in favor of completing all streets at one time. Closed Public Comment. 5 Town Council/Parking Authority April 19, 2016 Other Business Item # 5 continued Council discussed the matter. MOTION: Motion by Vice Mayor Marico Sayoc to approve the recommendations in the staff report; that staff and contractor review all pertinent communications from the neighborhoods so concerns are not repeated; that all previous studies be utilized; and that the conduit installation costs be highlighted when it comes back to Council for review and discussion. Seconded by Council Member Marcia Jensen. VOTE: Motion passed 4/1. Council Member Steve Leonardis voting no. 6. Property location: North Forty Specific Plan Area: Phase 1 Consider a request to modify a previous approval of an exception to the Story Pole Policy for the Phase 1 North Forty development applications. APNS: 424-07-024 through 027, 031 through 037, 070, 083 through 086, 090, and 100 (Continued from April 5 Council Meeting) Marni Moseley, Associate Planner, presented the staff report. Council discussed the matter. MOTION: Motion by Vice Mayor Marico Sayoc to deny the story pole exception and before a new Planning Commission meeting is scheduled that a joint study session between Town Council, Planning Commission, a special invitation to school board members that are affected and extensive public notice be done. Included in the study session should be: what is in the Environmental Impact Report (EIR), what elements went into the EIR, a better understanding of the traffic studies, what were the mitigations that went into the EIR, what would the development look like with and without a specific plan, the Housing Element, and the impact the new housing will have on the schools. Seconded by Council Member Marcia Jensen. VOTE: Motion passed unanimously. 6 Town Council/Parking Authority April 19, 2016 PUBLIC HEARINGS 7. Property Location: 16212 Los Gatos Boulevard. Planned Development Application PD-14-001, Mitigated Negative Declaration N.D-14-002. A. Consider adoption of a Mitigated Negative Declaration and adoption of a Mitigation Monitoring and Reporting Program. B. Consider a request for a Planned Development to demolish the existing building and to construct 11 single-family residences on property zoned CH. APN 523- 06-010 and 011. Property Owner: 16212 Los Gatos Boulevard LLC. Applicant: Stem Development. Marni Moseley, Associate Planner, presented the staff report. Opened Public Comment. Scott Plautz, Applicant, described the proposal. Markene Smith - Spoke in opposition to the proposed development. Barnaby James - Spoke in opposition to the proposed development. Public Hearings Item #7 – continued Audrey Christianson - Spoke in opposition to the development. Bruce McCoombs - Spoke in opposition to the proposed development and in favor of commercial development. Kathleen Romero - Spoke in opposition to the proposed development. Dick Clift - Spoke in opposition to the proposed development. Amy Despars - Spoke in opposition to the proposed development. Norman Plishka - Spoke in opposition to the proposed project, keeping trees, keeping standard setbacks. Scott Plautz, Applicant, made closing comments regarding the proposal. Closed Public Comment. Council discussed the matter. MOTION: Motion by Mayor Barbara Spector to approve the Planning Commission recommendation and deny application. Seconded by Council Member Marcia Jensen. VOTE: Motion passed unanimously. MOTION: Motion by Mayor Barbara Spector that the application should be commercial and staff to attempt to blend payment that has already been made with payments that will be due for new application . Seconded by Council Member Steve Leonardis. VOTE: Motion passed unanimously.
