BACKGROUND:
On April 19, 2016, the Town Council initiated the annual process of renewing the Landscape and
Lighting Assessment Districts 1 & 2 for the fiscal year commencing on July 1, 2016. In
particular, the Council adopted Resolution 2016-016 directing the preparation of the Engineer’s
Report for the two districts. A copy of the Engineer’s Report is provided as Attachment 8.
DISCUSSION:
In accordance with Resolution 2016-016 and pursuant to the requirements of the Landscaping
and Lighting Act of 1972, the attached Engineer’s Report contains the following information:
1. Plans and specifications for the maintenance of the existing improvements and for
proposed new improvements, if any, to be made within the assessment districts or within
any zones thereof;
2. An estimate of the costs of said proposed new improvements, if any, to be made along
with the costs of maintenance or servicing, or both, thereof, and of any existing
improvements, together with the incidental expenses in connection therewith;
3. A diagram showing the exterior boundaries of the assessment districts and of any zones
within said districts and the lines and dimensions of each lot or parcel of land within the
districts as such lot or parcel of land is shown on the County Assessor’s map for the fiscal
year to which the report applies, each of which lots or parcels of land shall be identified
by a distinctive number or letter on said diagram.
4. A proposed assessment of the total amount of the estimated costs and expenses of the
maintenance activities and proposed new improvements, if any, upon the several lots or
parcels of land in said districts in proportion to the estimated particular and distinct
benefits to be received by each of such lots or parcels of land, respectively, from said
improvements, including the maintenance or servicing, or both, thereof, and of the
expenses incidental thereto.

DISCUSSION (cont’d):
The recommended actions will maintain the assessments at each of the benefit zones at the
historic level, with no additions or reductions as these funding levels are appropriate to address
regular ongoing maintenance as well as capital maintenance as needed. Once the Council is
satisfied with the information provided in the Engineer’s Report, the process of renewing the
assessment districts for FY 2016/17 will continue. This includes setting the date and time for the
Public (Protest) Hearing for June 21, 2016.
Proposed Scope of Work for FY 2016/17
The proposed work for FY 2016/17 consists of both routine maintenance activities as well as
more substantial deferred maintenance projects that will use a portion of the available fund
balances in the respective Benefit Zones. On March 1, 2016, the Council approved the use of
$30,000 for pathway and pedestrian bridge repairs in the Kennedy Meadows Benefit Zone.
Project allocations for the remaining five Benefit Zone will be included as part of the FY
2016/17 Proposed Operating Budget. The proposed project allocations for each Benefit Zone are
shown in the table below:
Town staff will mail a Notice of Intention to Levy Annual Assessments for Fiscal Year 2016/17
to all property owners. This notice will include the public hearing date, time, and location.
Property owners may file a written protest to the Clerk Administrator at 110 East Main Street,
Los Gatos, CA 95030 no later than the public hearing of June 21, 2016.
The Council may also direct that modifications be made to the Engineer’s Report, if it so desires.
CONCLUSION:
Staff recommends that the Town Council adopt the attached seven resolutions to continue the
annual process of renewing the Landscape and Lighting Assessment Districts 1 & 2 for Fiscal
Year 2016/17.
ALTERNATIVES:
If the Council chooses not to adopt the seven resolutions, then the renewal process would halt
and staff would follow the alternative direction given by the Council. If the Council were to

ALTERNATIVES (cont’d):
decide not to renew the Assessment Districts, staff would look to Council for a policy direction
about whether the services currently provided by the Districts should continue and how.
The two most likely options that the Council could choose would be to either:
1. Give the responsibility for providing the services back to the property owners within the
Districts; (or)
2. Assume responsibility for providing the services through the Town’s General Fund
Operating Budget.
As the Districts provide for higher levels of landscape and lighting services within the specific
benefit zones than in other areas of the Town, staff does not recommend either of these two
approaches.
ENVIRONMENTAL ASSESSMENT:
This is not a project defined under CEQA, and no further action is required.
FISCAL IMPACT:
The landscape maintenance costs that are shown in this report for FY 2016/17 reflect the current
landscaping contract costs. Prior to the final approval of the Town’s budget in June, staff will
reconcile the maintenance cost figures to reflect the new updated costs.
There are no direct fiscal impacts on the Town's General Fund as a result of administering the
Landscape and Lighting Assessment Districts. All of the costs associated with the districts are
recovered via the assessments levied against the property owners within the districts. There are
no proposed increases in any of the parcel assessments for FY 2016/17 that would require a
ballot vote under Proposition 218.

FISCAL YEAR 2016/17
RESOLVED, by the Town Council of the Town of Los Gatos, California as follows:
WHEREAS, pursuant to the Landscaping and Lighting Act of 1972, on the 19th day of
April 2016, said Council did adopt its Resolution No. 2016-016 “A Resolution Describing
Improvements and Directing Preparation of Town Engineer's Report For Fiscal Year 2016/17"
for the Town of Los Gatos Landscape and Lighting Assessment Districts No. 1 & 2, in said
Town and did refer the proposed improvements to the Engineer of the Town and did therein
direct said Engineer to prepare and file with the Clerk Administrator of said Town a report, in
writing, all as therein more particularly described; and
WHEREAS, said Town Engineer prepared and filed with the Clerk Administrator a
report in writing as called for in said Resolution No. 2016-016 and under and pursuant to said
Act, which report has been presented to this Council for consideration; and
WHEREAS, said Council has duly considered said report and each and every part
thereof, and finds that each and every part of said report is sufficient, and that neither said report,
nor any part thereof should be modified in any respect.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the plans and specifications for the existing improvements and the proposed
new improvements to be made within the assessment districts or within any zone thereof,
contained in said report, be, and they are hereby preliminarily approved.

2. That the Engineer's estimate of the itemized and total costs and expenses of said
improvements, maintenance and servicing thereof, and of the incidental expenses in connection
therewith, contained in said report, be, and each of them are hereby preliminarily approved.
3. That the diagram showing the exterior boundaries of the assessment districts
referred to and described in said Resolution No. 2016-016 and also the boundaries of any zones
therein, and the lines and dimensions of each lot or parcel of land within said districts as such lot
or parcel of land is shown on the County Assessor's maps for the fiscal year to which the report
applies, each of which lot or parcel of land has been given a separate number upon said diagram,
as contained in said report, be, and it hereby is preliminarily approved.
4. That the proposed assessment of the total amount of the estimated costs and
expenses of the proposed improvements upon the several lots or parcels of land in said
assessment districts in proportion to the estimated benefits to be received by such lots or parcels,
respectively, from said improvements including the maintenance or servicing or both, thereof,
and of the expenses incidental thereto, as contained in said report, be, and they are hereby

5. That said report shall stand as the Engineer's Report for the purpose of all

generally consists of the following improvements:
Landscaping and appurtenances in the median
island and the street lights constructed as a part of
Tract No. 8306, Blackwell Drive and National
Avenue.
WHEREAS, on April 19, 2016, the Town Council ordered the Town Engineer to prepare
and file a report regarding Landscape and Lighting Assessment District No. 1--Blackwell Drive
Benefit Zone, regarding the improvements in the District and proposed assessment to support
those improvements; and
WHEREAS, the Town Engineer has prepared and filed that report; and
WHEREAS, the Town Council has considered and approved that report; and
WHEREAS, no substantial changes are proposed to be made in the improvements in the
District; and

in the District, the boundaries of the District and the benefit zones within the District, and the

WHEREAS, the Town Council intends to consider levying and collecting assessments
upon the assessable lots and parcels of land within the District that are equal to those levied and
collected in Fiscal Year 2015/16; and
WHEREAS, the proposed assessment should be set for public hearing in accordance
with the Streets and Highways Code,

WHEREAS, on April 19, 2016, the Town Council ordered the Town Engineer to prepare
and file a report regarding Landscape and Lighting Assessment District No. 1--Vasona Heights
Benefit Zone, regarding the improvements in the District and proposed assessment to support
those improvements; and
WHEREAS, the Town Engineer has prepared and filed that report; and
WHEREAS, the Town Council has considered and approved that report; and
WHEREAS, no substantial changes are proposed to be made in the improvements in the
District; and

WHEREAS, the Engineer's Report contains a detailed description of the improvements
in the District, the boundaries of the District and the benefit zones within the District, and the
proposed assessments upon assessable lots and parcels of land within the District; and
WHEREAS, the Town Council intends to consider levying and collecting assessments
upon the assessable lots and parcels of land within the District that are equal to those levied and
collected in Fiscal Year 2015/16; and
WHEREAS, the proposed assessment should be set for public hearing in accordance
with the Streets and Highways Code,
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

The wetlands mitigation and monitoring plan was prepared by H.T. Harvey & Associates,
Ecological Consultants, dated November 11, 1994, their file number 733-04, 11 pages. A revised
wetlands mitigation plan is contained in a letter to the U.S. Army Corp of Engineers and
California Regional Water Quality Control Board dated August 30, 1995 and as -built plans in a
