RESOLUTION OF THE TOWN OF LOS GATOS AUTHORIZING
PUBLICATION OF SUMMARIES OF ORDINANCES IN ACCORDANCE
WITH GOVERNMENT CODE SECTION 36933
WHEREAS:
A. The Town of Los Gatos currently publishes the entire text of all ordinances
and ordinance amendments in a local newspaper of general circulation;
B. Publication costs sometimes equal two thousand dollars ($2,000) or more for
a single ordinance; and the Town Clerk's publication budget for fiscal year 90 -91 is fifteen
thousand five hundred dollars ($15,500);
C. Government Code Section 36933 sets forth certain procedures which allow
a city to publish a summary of a proposed ordinance instead of the entire ordinance; and
D. Adopting a procedure which implements section 36933 will enable the Town
to realize substantial cost savings in future fiscal years while assuring that the public is well
informed.
BE IT RESOLVED:
A. The Town Attorney is designated to prepare a summary of any proposed
ordinance or proposed amendment to an existing ordinance whenever requested to do so
by the Town Manager.
B. The Town Manager may request that the Town Attorney prepare a summary
whenever he /she determines that publication of a summary instead of the entire ordinance
will be cost effective.
C. The summary shall be published at least five (5) days prior to the Town
Council meeting at which the proposed ordinance or proposed amendment thereto is to be
adopted and a second time, within fifteen (15) days after adoption with the names of those
Town Council members voting for and against the ordinance or amendment.
D. The Town Attorney may determine that the title of the ordinance constitutes
a sufficient summary or may add such additional information as he /she deems appropriate.
E. The Town Clerk shall post a certified copy of the full text of the proposed
ordinance or proposed amendment on the bulletin board in the office of the Town Clerk
at least five days prior to the Town Council meeting at which the proposed ordinance or
amendment or alteration thereto is to be adopted, and within fifteen (15) days
after adoption of the ordinance or amendment shall post in the same place a certified copy
of the full text of such adopted ordinance or amendment along with the names of those
Town Council members voting for and against the ordinance or amendment.
F. Whenever an ordinance incorporates maps, the Town Clerk may fulfill the
publication requirements of section 36933 by posting the maps on the bulletin board in the
office of the Town Clerk.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 3rd day of June, 1991 by the following vote.
