RESOLUTION OF THE TOWN OF LOS GATOS APPROVING
APPEAL OF A DECISION OF THE PLANNING COMMISSION
APPROVING A REQUEST FOR PERMISSION TO MAINTAIN
AN EXISTING APARTMENT COMPLEX WITHOUT THE CONDITION
OF APPROVAL REQUIRING PAVING AND STRIPING OF THE
PARKING AREA FOR PROPERTY LOCATED IN THE R- 1:10,000 ZONE,
CONDITIONAL USE PERMIT APPLICATION U -90 -6
(42 CENTRAL AVENUE /MARLENE RODMAN)
WHEREAS:
A. Marlene Rodman, owner and appellant, has appealed a decision of the Planning
Commission as follows: condition of approval that paving and striping of the parking area
at an existing apartment complex in the R:1:10,000 zone located at 42 Central Avenue.
(Conditional Use Permit Application U- 90 -6); and,
B. A public hearing was held on May 20, 1991.
BE IT RESOLVED:
The Town Council hereby finds the Planning Commission erred by requiring paving
and striping of the parking area at 42 Central Avenue.
The Town Council hereby deletes the condition of approval for Conditional Use
Permit Application U -90 -6 requiring paving and striping of the parking area at 42 Central
Avenue.
Based on the foregoing findings, the Town Council hereby grants the appeal subject
to the condition that a second exit to grade shall be provided from the third floor apartment
as required by the Uniform Housing Code to the satisfaction of the Director of Building
Services, and modifies Conditional Use Permit Application U -90 -6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 3rd day of June, 1991 by the following vote.
