RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
LOS GATOS REMANDING TO THE EARTHQUAKE RESTORATION
COMMITTEE A REQUEST FOR PERMISSION TO REINSTATE
A CONDITIONAL USE PERMIT FOR AN EXISTING THEATRE
CONDITIONAL USE PERMIT APPLICATION EU -79 -5A
(41 NORTH SANTA CRUZ AVENUE /CARMEL CORMACK)
WHEREAS:
A. Carmel Cormack, property owner and applicant, has requested permission to
reinstate Conditional Use Permit Application EU -79 -5A for an existing theatre in the C-
2 zone. Property located at 41 North Santa Cruz Avenue.
B. Carmel Cormack, property owner and applicant, owns the Los Gatos Theatre,
located at 41 North Santa Cruz Avenue, which has been closed since the October 1989
Loma Prieta earthquake. The theatre was operating under a 1979 Conditional Use Permit
before the October 1989 earthquake.
C. This matter was considered by the Earthquake Restoration Committee on May
23, 1991.
D. A public hearing was held before the Town Council on June 17, 1991.
BE IT RESOLVED:
The Town Council hereby finds that the Conditional Use Permit Application EU-
79 -5A is remanded to the Earthquake Restoration Committee for further consideration of
the following issues:
1. Means of ensuring that the best possible projection and sound systems are used,
and that audience age restrictions are enforced.
2. Preserve the exterior appearance including the marquee and evaluate seismic
feasability of preserving the pre- earthquake ticket booth.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 1st day of July, 1991 by the following vote.
