RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING APPEAL OF A DECISION OF THE PLANNING COMMISSION
DENYING SUBDIVISION APPLICATION M- 73 -15D AND NEGATIVE
DECLARATION 90 -2 FOR A FIVE -LOT SUBDIVISION
(WOODED VIEW DRIVE /JOE WUCHER AND TERRY ROSE)
WHEREAS:
A. Joe Wucher, owner and appellant, has appealed a decision of the Planning
Commission denying approval of a five -lot subdivision of 19.1 acres zoned HR -2 1/2 zone
located at Wooded View Drive. (Subdivision application M- 73 -15D and negative declaration
90 -2.)
B. Whereas the proposed water facilities do not meet the standards of a public
water system and are insufficient to provide the required level of consistent domestic supply
and fire service.
C. The Hillside Specific Plan states that service from a public water system is a
prerequisite for urban densities in the hillside areas.
D. A public hearing was held on June 17, 1991.
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The Town Council hereby finds that the Planning Commission did not err in
their decision to deny the subdivision application.
B. The Town Council further hereby finds that the proposed water system does not
meet the standards of a public system.
C. Based on the foregoing findings, the appeal is denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 1st day of July, 1991 by the following vote.
