RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING THE APPEAL OF TRANSIENT OCCUPANCY TAX FOR PROPERTY
LOCATED AT 50 SARATOGA AVENUE AND UPHOLDING THE TAX
ADMINISTRATOR'S DETERMINATION OF TRANSIENT OCCUPANCY TAX,
PENALTIES AND INTEREST DUE
(50 SARATOGA AVENUE /NORMAN E. AND JEAN P. McFATE)
WHEREAS:
A. Norman E. and Jean P. McFate, owner and appellant, have appealed the Tax
Administrator's decision regarding monies due under the transient occupancy tax provision
of the Town code, including penalties and interest for property located at 50 Saratoga
Avenue, commonly known as the Los Gatos Lodge;
B. A public hearing was held on May 20, 1991. Determination of the appeal was
continued to July 1, 1991; and
C. Appellant Norman E. McFate, owes the Town of Los Gatos transient
occupancy taxes for the quarter ending December 31, 1990 and for the quarter ending
March 31, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the transient occupancy tax is due and
that interest and penalties have accrued.
B. The Town Council further hereby finds that the determination of the Tax
Administrator regarding the amount of taxes due including penalty and interest are just and
proper as specified in the Town Code.
C. Based on the foregoing findings the appeal is denied and the amount of
transient occupancy tax including penalties and interest are due.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
