RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING APPEAL OF THE PLANNING DIRECTOR AND DIRECTOR OF
BUILDING SERVICES' DECISION DENYING THE DEMOLITION OF A
SINGLE - FAMILY RESIDENCE DAMAGED BY THE OCTOBER 17, 1989
EARTHQUAKE IN THE R -1D -LHP ZONE, ARCHITECTURE AND
SITE APPLICATION ES -91 -49
(237 UNIVERSITY AVENUE /MIKE & DAVE HERNANDEZ)
WHEREAS:
A. Mike Hernandez and Dave Hernandez, property owners and appellants, have
appealed the decision of the Planning Director and Director of Building Services denying
the demolition of a single - family residence damaged by the October 17, 1991 earthquake.
Property located in the R -1D -LHP zone (Architecture and Site Application ES- 91 -49);
B. The Earthquake Demolition Committee reviewed the applicants' request to
demolish the 1,000 square foot one -story single family residence;
C. The Town's records indicate the home was constructed in 1896 and this
residence is part of the University - Edelen Historic District and is considered to be a
contributor to the district;
D. The appellants and owners have not submitted any plans for a replacement
structure or structural report or any evidence that rehabilitation would be more expensive
than demolition and reconstruction; and
E. A public hearing was held on July 15, 1991.
RESOLVED:
A. The Town Council hereby finds that the Planning Director and Director of
building Services did not err in their decision to deny the demolition of the residence
located at 237 University Avenue damaged by the October 17, 1991 earthquake.
B. The Town Council further finds that the applicant has not submitted a
structural report or proposed replacement plan for the residence.
C. Based on the foregoing findings, the appeal is denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 5th day of August, 1991 by the following vote.
