RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
AUTHORIZING THE ADOPTION OF AN AMENDMENT TO THE
AGREEMENT WITH THE AMERICAN NATIONAL RED CROSS
FOR DISASTER RELIEF
WHEREAS, Town of Los Gatos, a California municipality organized and operated
under the Constitution and laws of the State of California wishes to amend its agreement
with the American National Red Cross for funds and continue to participate with the
American National Red Cross in rehabilitating residential structures damaged or destroyed
in the October 17, 1989, earthquake and subsequent aftershocks; and
WHEREAS, American National Red Cross is authorized to make funds
available for grants for the purpose of completing housing rehabilitation or reconstruction;
and
WHEREAS, the Town of Los Gatos wishes to continue to obtain from the
American National Red Cross funds for the purpose of providing grants for housing
rehabilitation costs for eligible homeowners under a local housing rehabilitation program
and providing for an administrative fee payable to the Local Agency for such services:

NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS
GATOS DOES HEREBY authorize the Town Manager to execute the amendment attached
as Exhibit A extending the Town's agreement with American National Red Cross.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 16th day of September, 1991, by the following
vote:

This First Amendment ( "Amendment ") to the Agreement For Human Services Project
( "Agreement) is entered into as of the 25th day of Au 1991 by and
between THE AMERICAN NATIONAL RED CROSS ("ARC" ), a national nonprofit
corporation, and TOWN OF LOS GATOS
( "Grantee "), a municipal corporation in the state of California
RECITALS
WHEREAS, ARC and Grantee entered into that certain Agreement as of the 1 st day
of October 1.990 ;and
WHEREAS, under Article I the Agreement, ARC agrees to make available to Grantee
certain amounts from the ARC's Special Disaster Relief Fund ( "SDRF ") and Grantee agrees
to use the SDRF funds to achieve certain tasks and goals within the stated project budget and
terms and conditions of the Agreement; and
WHEREAS, ARC and Grantee mutually desire to amend the term of the Agreement as
provided in this Amendment;
NOW, THEREFORE, in consideration of the foregoing premises and other good and
valuable consideration, the receipt of which is hereby acknowledged, the parties hereto agree
to this Amendment and therefore amend the Agreement as follows:
ARTICLE I
SECTION 1.01 TERM OF AGREEMENT. The term of the Agreement shall be amended
and the new term shall be from October 1 . 1990 through October 1 , 1992.
ARTICLE II
All other provisions of the Agreement not expressly altered by this Amendment shall remain
unchanged and are in full force and effect.
IN WITNESS WHEREOF, the parties hereto, each acting under due and proper
authority, have executed this Agreement as of the date first above written.
