RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
AUTHORIZING THE MAYOR TO EXECUTE A
STORM DRAINAGE EASEMENT THROUGH
OAK MEADOW PARK (113 BLOSSOM HILL ROAD)
RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa Clara,
State of California, that the TOWN OF LOS GATOS grant that Storm Drainage Easement
across Oak Meadow Park to Guadalupe Rubbish Disposal Co., Inc., a copy of which is
attached hereto, and that the Mayor is authorized, and is hereby directed, to execute said
easement in the name and in behalf of the TOWN OF LOS GATOS.
FURTHER RESOLVED, that the Town Clerk is hereby directed to record said
easement with the County Recorder of the County of Santa Clara.

STORM DRAINAGE EASEMENT

The TOWN OF LOS GATOS, a municipal corporation, County of Santa Clara, State
of California, as Grantor, hereby grants to Guadalupe Rubbish Disposal Co., Inc., as
Grantee, the following easement:
Legal description as per Exhibits "A" and 'B ", attached hereto
and made a part herein.
TO HAVE AND TO HOLD said easement for the purpose of constructing,
completing, reconstructing, repairing, maintaining, and operating storm drainage facilities
and appurtenances for said Grantee, together with the right of ingress and egress, therefor.
Neither Grantor or successors in interest shall erect nor construct any building or other
structure, nor drill or operate any sort of well, within the limits of the above described
easement.
GRANTOR HEREBY FURTHER GRANTS TO GRANTEE the right to the use
of such land on each side of the hereinabove described easement as may be reasonably
necessary for the deposit of earth and construction materials and the use and operation of
equipment during the construction, maintenance, repair, or replacement of said storm
drainage facilities and appurtenances.

GRANTEE HEREBY AGREES that all work within the hereinabove described
easement shall be coordinated with the Director of Parks, Forestry and Maintenance
Service, and shall be so scheduled as to not interfere with the operation of the Billy Jones
Wildcat Railroad.

All that real property situated in the Town of Los Gatos, County of Santa Clara, State of
California, described as follows:
A STRIP OF LAND TEN FEET IN WIDTH, THE BOUNDARY OF
WHICH IS MORE PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING at a point being the most southerly corner
of that certain parcel of land conveyed to the Guadalupe
Rubbish Disposal Co., Inc. by deed recorded on September 6,
1973, in Book 0552, Official Records, Pages 268 and 269, Santa
Clara County Records; thence leaving the said most southerly
corner of that certain parcel of land conveyed to the Guadalupe
Rubbish Disposal Co., Inc., S 30° 15' W, 65.00 feet; thence at
right angles, N 59° 45' W, 10.00 feet and N 30° 15' E, 62.04
