RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING THE APPEAL OF A DECISION OF THE PLANNING COMMISSION
APPROVING PLANS FOR A SECOND STORY ADDITION TO AN EXISTING
RESIDENCE ON PROPERTY IN THE R- 1:8000 ZONE; SECOND STORY
ADDITION APPLICATION X -91 -8

APPELLANT: MARY WRIGHT)
WHEREAS:
A. Mary Wright, appellant, has appealed a decision of the Planning Commission
approving the plans for the construction of a second story addition to an existing residence
on property in the R- 1:8000 zone. Property is located at 54 Ellenwood Avenue. Second
Story Addition Application X -91 -8; and
B. The Planning Commission heard the appeal on July 24, 1991 and August 28,
1991; and
C. The Planning Commission found the second story design in compliance with the
Town's residential standards and that the applicant took reasonable steps to ensure the
addition would have minimal impact on neighboring properties; and
D. A public hearing was held by the Town Council on October 7, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the Planning Commission did not err in
their decision and that the proposed development of the site is a proper use of the parcel.
B. Based on the foregoing findings, the appeal is denied, and the project is
approved subject to the following conditions:
TO THE SATISFACTION OF THE PLANNING DEPARTMENT:
1. The final plans shall note that the window in the bathroom be and remain
opaque.
TO THE SATISFACTION OF THE TOWN ENGINEER:
2. A deed restriction shall be recorded which prohibits expansion into or
conversion to habitable space of the roof addition area.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 21st day of October, 1991 by the following vote.
