RESOLUTION OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO SIGN
AN AMENDMENT TO AGREEMENT
BETWEEN THE TOWN OF LOS GATOS AND APPLIED GEOSYSTEMS
FOR CONSULTANT SERVICES FOR PARKING ASSESSMENT DISTRICT
LOT #4 - PROJECT 8805
WHEREAS, the Regional Water Quality Control Board requires ongoing
groundwater monitoring at Parking Lot #4; and
WHEREAS, additional studies were required by Town staff for preparation
of soil and water remediation plans; and
WHEREAS, the Town required Applied Geosystems to provide bid period
services, including specification preparation, bid proposal analysis, and vendor
recommendation for remediation services.
THEREFORE, BE IT RESOLVED, that the contract between the Town of Los
Gatos and Applied Geosystems for consultant services for the Parking Assessment
District Lot #4 (Project 8805) be amended as shown on the attached (Exhibit A).
BE IT FURTHER RESOLVED, by the Town Council of the Town of Los Gatos,
County of Santa Clara, State of California, that the Town Manager is authorized,
and is hereby directed, to execute said agreement amendments in the name and in
behalf of the Town of Los Gatos.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 4th day of November, 1991 by the
following vote:

AMENDMENTS TO AGREEMENT BETWEEN THE TOWN OF LOS GATOS
AND APPLIED GEOSYSTEMS FOR CONSULTANT SERVICES
FOR THE PARKING ASSESSMENT DISTRICT - LOT #4 (PROJECT 8805)
1. Task 4. Design the plans and oreoaration of specifications for the
installation of the remediation systems /facilities in a form proper for
contractor quote /bidding
Add a new paragraph following Paragraph 2, to read as follows:
"The Town has requested and the Engineer has agreed to provide
bid period services, including specification preparation, bid
proposal analysis, and vendor recommendation."
2. Task 6. Continuation of Quarterly monitoring and reports (on an annual
renewal basis).
Delete the existing paragraph, and add the following paragraph:
"Ongoing quarterly monitoring and reports are required by the
Regional Water Quality Board. The Engineer will provide these
services."
3. Amend Article VII - Fee Compensation as follows:
Task 3
The maximum fee for services specified under Task 3 - Interim
Remedial Action Plan and Cost Analysis of Article 1 without
further authorization shall be $32,819.35.
Task 4
The maximum fee for services specified under Task 4 -
Engineering Plans and Specifications for the Installation of the
Remediation System without further authorization shall be
$46,000.60.
Between Task 5 and Task 6 delete total $154,900.
Task 6
Delete existing language and add:
"The fee for services specified under Task 6, Continuing
Quarterly Monitoring shall be $48,326.03."
After Task 6, add:.. TOTAL $229,146.
