RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
GRANTING THE APPEAL OF THE PLANNING COMMISSION DECISION
TO UPHOLD THE PLANNING DIRECTOR'S DECISION TO DENY
OCCUPANCY OF A STRUCTURE FOR OFFICE USE IN THE LM -ZONE
(631 UNIVERSITY AVENUE /OWNER /APPLICANT: HANDEL JONES)
WHEREAS:
A. Handel Jones, property owner /applicant, has appealed a decision of the Planning
Commission to uphold the Planning Director's decision to deny occupancy of a structure
located at 631 University Avenue; and
B. A Town Council public hearing was held on May 20, 1991 and continued to July
1, 1991 and continued to August 19, 1991 to give Handel Jones time to provide evidence
that the business located at 631 University Avenue, known as International Business
Strategies, Inc., was a retail business; and
C. A Town Council public hearing was held on September 16, 1991 and the matter
was continued at the request of Handel Jones to October 7, 1991 and October 21, 1991.
RESOLVED:
A. The Town Council hereby finds that the Planning Commission erred in their
decision by finding that the use involved office rather than manufacture operations.
The Town Council hereby finds that the property owner /applicant's assembly and
production of books for publication on site is manufacture, a permitted use in the LM-
Zone.
B. Based on the foregoing findings, the Town Council hereby grants the appeal and
directs the Planning Director to allow occupancy of the structure located at 631 University
Avenue.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 4th day of November, 1991 by the following vote.
