RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
REMANDING TO THE PLANNING COMMISSION A REQUEST FOR
PERMISSION TO OPERATE A FULL SERVICE RESTAURANT WITH A
SEPARATE BAR, OUTDOOR SEATING, AND THE UNLIMITED SALE OF
ALCOHOLIC BEVERAGES FOR CONSUMPTION ON THE PREMISES AND
EXTERIOR MODIFICATIONS ON PROPERTY IN THE C -2 ZONE.
CONDITIONAL USE PERMIT APPLICATION U -85 -213 AND ARCHITECTURE
AND SITE APPLICATION S- 91 -43.

WHEREAS:
A. Chevy's, Inc., appellant, has requested approval to operate a full service
restaurant with a separate bar, outdoor seating with the sale of alcoholic beverages for
consumption on the premises and exterior modifications on property in the C -2 zone.
Conditional use permit application U -85 -213 and architecture and site application S- 91 -43.
B. The Planning Commission considered the matter on August 28, 1991 and denied
the application due to lack of adequate parking for the planned use.
C. A public hearing of the Town Council was held on October 7, 1991.
RESOLVED:
A. The Town Council hereby finds that the application should be remanded to the
Planning Commission for review and further consideration of the following:
1. Reduction of the seating capacity to the number of seats for which parking
is available based on contributions to the Parking District.
2. Re- design of the patio area to reflect concerns raised by the Police Chief.
3. Conduct a public hearing for neighborhood residents to determine whether
modification of the permit parking program would mitigate potential parking impacts
of this project.
4. Landscaping plans for the entire site.
5. Plans and agreements to provide employee parking sufficiently distant from
the site to ensure that parking supply in the area is not reduced.
6. An enforcement program for security in the parking lot after hours of
operation.
7. Hear any additional concerns.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 4th day of November, 1991 by the following vote.
