RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING THE APPEAL OF THE PLANNING COMMISSION DENYING A
REQUEST FOR APPROVAL OF A ZONE CHANGE FROM R -ID (SINGLE - FAMILY
RESIDENTIAL, DOWNTOWN) TO R -1D -PD (SINGLE- FAMILY
RESIDENTIAL,DOWNTOWN- PLANNED DEVELOPMENT) FOR THE
CONSTRUCTION OF A 16 UNIT RESIDENTIAL DEVELOPMENT. NEGATIVE
DECLARATION: ND -91 -6 AND ZONE CHANGE APPLICATION.

WHEREAS:
A. Marko Gera, property owner /appellant, has appealed a decision of the Planning
Commission denying a request for approval of a zone change from R -1D (single - family
residential, downtown) to R -1D -PD (single - family residential, downtown - planned
development) for the construction of a 16 unit residential development. Negative
Declaration: ND -91 -6 and Zone Change Application. Property located at 20 Dittos Lane.
B. The applicant proposed a Planned Development including the demolition of four
residential structures and the construction of 16 townhouses including two BMP units on
1.3 acres.
C. The Development Review Committee reviewed the application on May 28, 1991
and again on July 30, 1991. The Historic Resources inventory has revealed that buildings
on the site have historical significance.
D. The Planning Commission considered the matter on September 25, 1991 and
denied the zone change application finding that the historic structures should be
incorporated into further development of the site.
E. The Town Council held a public hearing on November 4, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the Planning Commission did not err in
their decision denying a request for approval of a zone change from R -11) (single - family
residential, downtown) to R -1D -PD (single - family residential, downtown- planned
development) for the construction of a 16 unit residential development.
B. Based on the foregoing findings, the Town Council hereby denies the appeal.
Pursuant to Los Gatos Town Code section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 18th day of November, 1991 by the following vote.
