RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING THE APPEAL OF THE PLANNING COMMISSION DECICION
APPROVING PLANS FOR THE CONSTRUCTION OF A 64 -UNIT MULTI - FAMILY
HOUSING DEVELOPMENT AND A CHILD CARE CENTER ON APPROXIMATELY
3.4 ACRES OF PROPERTY IN THE O -PD ZONE.
ARCHITECTURE AND SITE APPLICATION: S- 86 -24C.
PROPERTY LOCATED AT: 634 W. PARR AVENUE
PROPERTY OWNER: NATIONAL MEDICAL ENTERPRISES
APPLICANT: MID - PENINSULA HOUSING COALITION.
APPELLANT: CHESTER MALLORY, PRESIDENT,
WEST PARR NEIGHBORHOOD ASSOCIATION.
WHEREAS:
A. Chester Mallory, appellant, has appealed a decision of the Planning Commission
approving plans for the construction of a 64 -unit multi - family housing development and a
community facility which will be used as a nonprofit day care center on approximately 3.4
acres of property in the O -PD zone. Architecture and Site Application S -86 -24C. Property
located at 634 W. Parr Avenue. Property Owner: National Medical Enterprises.
B. The Planning Commission considered the matter on October 9, 1991 and found
the application is consistent with the Planned Development Ordinance and incorporates all
the applicable performance standards.
E. The Town Council held a public hearing November 4, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the Planning Commission did not err in
their decision approving plans for the construction of a 64 -unit multi - family housing
development and a community facility which will be used as a nonprofit day care center on
approximately 3.4 acres of property in the O -PD zone.
B. Based on the foregoing findings, the Town Council hereby denies the appeal.
Pursuant to Los Gatos Town Code section 1 -15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 18th day November, 1991 by the following vote.
