1991-268-Denying Appeal Of The Planning Commission's Denial Of An Application Tp Permit Demolition Of An Existing Single-Family Residence And Construction Of An Oil Chance ANd Lubrication Facility On Property In The LM ZoneRESOLUTION 1991 -268 RESOLUTION OF THE TOWN OF LOS GATOS DENYING APPEAL OF THE PLANNING COMMISSION'S DENIAL OF AN APPLICATION TO PERMIT DEMOLITION OF AN EXISTING SINGLE - FAMILY RESIDENCE AND CONSTRUCTION OF AN OIL CHANGE AND LUBRICATION FACILITY ON PROPERTY IN THE LM ZONE; CONDITIONAL USE PERMIT APPLICATION U -91 -5; ARCHITECTURE AND SITE APPLICATION S- 91 -39; AND NEGATIVE DECLARATION ND -91 -5 (646 N. SANTA CRUZ AVENUE /OWNERS: JOHN AND NOLA HEINDEL APPLICANT: SETH BLAND /OIL CHANGERS) WHEREAS: A. Seth Bland /Oil Changers, applicant and appellant, has appealed a decision of the Planning Commission denying a request to demolish an existing single- family residence and to construct an oil change and lubrication facility on property in the LM Zone (Conditional Use Permit Application U -91 -5; Architecture and Site Application S- 91 -39; and Negative Declaration ND- 91 -5). Property located at 646 N. Santa Cruz Avenue; B. The Development Review Committee reviewed the application on May 20, 1991 and June 24, 1991 and found the application consistent with the Downtown Specific Plan and General Plan; C. The Planning Commission heard this matter on October 8, 1991, and denied the application because it is inconsistent with the recommendations of the Commercial Specific Plan Report and because traffic generated by this project would adversely affect existing conditions in the area; and D. The Town Council held a public hearing on August 18, 1991. RESOLVED: A. The Town Council hereby finds that no evidence or testimony was presented that the decision of the Planning Commission was in error. B. Based on the foregoing findings, the appeal is denied. Pursuant to Los Gatos Town Code Section 1 -15, the time for seekingjudicial review for the Town Council decision is governed by California Code of Civil Procedure Section 1094.6. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 2nd day of December, 1991 by the following vote.
