RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
GRANTING THE APPEAL OF THE PLANNING COMMISSION DECISION
APPROVING A REQUEST TO APPROVE PLANS FOR THE CONSTRUCTION
OF A SINGLE - FAMILY RESIDENCE IN THE R- 1:10,000 ZONE;
ARCHITECTURE AND SITE APPLICATION S -91 -60

APPELLANT: SUSAN BRANCH)
WHEREAS:
A. Susan Branch, appellant, has appealed a decision of the Planning Commission
approving plans for the construction of a single - family residence in the R- 1:10,000 zone.
Architecture and Site Application S- 91 -60. Property located at 5 Central Court;
B. Dave Cunningham, property owner, proposes to construct a 2,896 square foot,
two story single family dwelling on a 9,286 square foot nonconforming vacant lot in the R-
1:10 zone;
C. The Planning Commission heard the application on October 23, 1991 and
approved the application subject to conditions; and
D. The Town Council held a public hearing on December 2, 1991.
RESOLVED:
A. The Town Council hereby finds that the Planning Commission erred in its
decision by finding that the proposed residence was compatible with the neighborhood.
The size and mass of the proposed residence are out of scale with surrounding residences.
B. Based on the foregoing findings, the Town Council hereby grants the appeal and
remands the project to the Design Review Committee and Planning Commission.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 16th day of December, 1991 by the following vote.
