Commercial Building On .37 Acres Of Property In The LM ZoneRESOLUTION 1992 -65 RESOLUTION MODIFYING A DECISION OF THE PLANNING COMMISSION TO DENY A REQUEST FOR APPROVAL OF PLANS TO CONSTRUCT A 5,100 SQ. FT. COMMERCIAL BUILDING ON .37 ACRES OF PROPERTY IN THE LM ZONE. NEGATIVE DECLARATION ND -91 -9 AND ARCHITECTURE AND SITE APPLICATION 5- 91 -47. PROPERTY LOCATED AT 575 N. SANTA CRUZ AVENUE APPELLANT & PROPERTY OWNER: LA MANCHA DEVELOPMENT COMPANY WHEREAS: A. La Mancha Development Company, property owner and appellant, has appealed a decision of the Planning Commission denying a request for approval of plans to construct a 5,100 sq. ft. commercial building on .37 acres of property in the LM Zone. Negative Declaration ND -91 -9 and Architecture and Site Application S- 91 -47. Property located at 575 N. Santa Cruz Avenue. B. The Planning Commission heard the matter on January 8, 1992 and continued the hearing directing the applicant to redesign the building. C. The Planning Commission considered the revised application on February 26, 1992 and directed the applicant to redesign the building, however, applicant would not agree to a continuance to redesign the building and the Planning Commission denied the application. D. A Town Council public hearing was held on April 6, 1992. BE IT RESOLVED: The Town Council grants the appeal in part, finds that the Planning Commission erred due to constraints not necessarily under their control, modifies the decision of the Planning Commission in part, and remands the project to the Commission for review and decision on a project re- designed to focus on creating a roof line consistent with the height and design of adjacent structures, using wood or other materials (but not metal) for exterior siding to soften the exterior, developing a design consistent with the Town's historical heritage, and ensuring that an evergreen tree comparable in growth rate and size to a Sycamore tree is planted in the rear parking area to screen the residential neighbors. Pursuant to Los Gatos Town Code section 1.10.085, the time for seeking judicial review for the Town Council decision is governed by California Code of Civil Procedure section 1094.6. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 20th day of April, 1992, by the following vote.
