1992-077-The Execution Of Separate Agreements With Yuki Farms And The Santa Clara County Traffic Authority For The Installation Of A Storm Drain Line Under Highway 17RESOLUTION 1992 -77 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS RATIFYING THE TOWN MANAGER'S AUTHORIZATION TO PROCEED WITH PRELIMINARY WORK AND AUTHORIZING THE EXECUTION OF SEPARATE AGREEMENTS WITH YUKI FARMS AND THE SANTA CLARA COUNTY TRAFFIC AUTHORITY FOR THE INSTALLATION OF A STORM DRAIN LINE UNDER HIGHWAY 17 RESOLVED, by the Town Council of the Town of Los Gatos ratifies the agreement contained in the Town Manager's letter to Will Kempton authorizing the Traffic Authority to proceed with preliminary work for the installation of a storm drain line under Highway 17 (attached as Exhibit A). FURTHER RESOLVED, by the Town Council of the Town of Los Gatos that the Town Manager is authorized to enter into separate agreements with Yuki Farms and the Santa Clara County Traffic Authority for the installation of a storm drain line under Highway 17 (attached as Exhibits B and Q. This storm drain is located north of Lark Avenue and is being installed as part of the Route 85 /Highway 17 Interchange pursuant to CalTrans Encroachment Permit 0492 -NTN -0726. This storm drain is extremely important to the Town since it will provide a critical drainage connection to Los Gatos Creek for the area east of Highway 17 along Los Gatos Boulevard which will become particularly critical with future widening of Los Gatos Boulevard. The Town is currently in the process of completing the staff report and an agreement between Mr. Yuki and the Town regarding this matter. I understand that your staff will submit a draft agreement between the Town and the Traffic Authority regarding installation of the storm drain on the morning of May 8th. On May 11, the Town Council will consider these agreements and ratification of this commitment of funds. If the Council approves the agreements, I understand that you will forward the agreement between the Town and the Traffic Authority to your board for approval. The Town appreciates your cooperation.
