RESOLUTION OF THE TOWN OF LOS GATOS
AUTHORIZING TOWN MANAGER TO EXECUTE
REVISED RISK COVERAGE AGREEMENT WITH
ASSOCIATION OF BAY AREA GOVERNMENTS (ABAG)
WHEREAS, the Town of Los Gatos is empowered under Government ode
Section 989 et sue., 6500 et .g4. and Labor Code Section 3700 to insure itself against
liability and other losses, workers' compensation claims and to provide insurance and self-
insurance in any desired combination; and
WHEREAS, the Town is a member of the Association of Bay Area Governments
(ABAG); and
WHEREAS, the Town desires to contract with ABAG and other members of
ABAG to pool their self- insured losses; jointly purchase excess insurance;and to develop
effective risk management and loss control programs to reduce the amount and frequently
of its losses (hereafter referred to as the 'PLAN Program "); and
WHEREAS, the Town executed and delivered the Risk Coverage Agreement
dated as of June 2, 1986, by and among ABAG and other cities participating in the PLAN
Program including the Town; and
WHEREAS, the Revised Risk Coverage Agreement dated as of July 1, 1992, is
on file with the Town Clerk and is available for review by members of the Town Council
and members of the general public; and
WHEREAS, the Revised Risk Coverage Agreement provide for the continuation
of the PLAN Program in a more flexible form with a wider range of insurance coverages;
and
WHEREAS, the Board of Directors of the ABAG PLAN Corporation
representing participating cities in the PLAN program have recommended approval of the
Revised Risk Coverage Agreement.
NOW, THEREFORE, BE IT RESOLVED that the Town Manager or his
designee is hereby authorized and directed to execute and deliver the Revised Risk
Coverage Agreement in substantially the form on file with the Town Clerk to the
Association of Bay Area Governments and to execute and deliver such other documents as
may be reasonably necessary to effectuate the Revised Risk Coverage Agreement.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 15th day of June, 1992 by the following vote:
