1992-128 - Prohibiting parking except by preferential parking permit on portions of certain public streets, defining terms and fees for obtaining permitsRESOLUTION 1992 .128 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS PROHIBITING PARKING EXCEPT BY PREFERENTIAL PARKING PERMIT ON PORTIONS OF CERTAIN PUBLIC STREETS, DEFINING TERMS AND FEES FOR OBTAINING PERMITS AND RESCINDING RESOLUTIONS 1983 -4, 1983- 76,1983- 87,1985- 7,1985 -85, 1986 -32, 1989 - 186,1989 -208, AND 1990 -215 THE TOWN COUNCIL OF THE TOWN OF LOS GATOS HEREBY RESOLVES: Pursuant to Town Code Section 15.40.080 and California Vehicle Code Section 22507, which authorizes local regulation of parking prohibition during certain hours, the following regulations are re- established for Preferential Parking Zones within the Town limits of Los Gatos: SECTION I - ALMOND GROVE DISTRICT: (1983 -4, 1983 -76, 1983 -87, 1990- 215) 1. STOPPING, STANDING, OR PARKING PROHIBITED. Stopping, standing, or parking of a motor vehicle without a Preferential Parking Permit or Guest Pass issued by the Town of Los Gatos is hereby prohibited between the hours of 6:30 P.M. and 2:00 A.M. daily on the following street(s): a. Almendra Avenue, both sides, from Tait Avenue to a point 400 feet easterly; b. Bachman Avenue, north side, from Massol Avenue to a point 500 feet east of Tait Avenue; C. Bachman Avenue, south side, between Massol Avenue and Victory Lane. d. Nicholson Avenue, both sides, between Tait Avenue and Victory Lane; e. Tait Avenue, both sides, between Almendra Avenue and Nicholson Avenue; £ Wilder Avenue, both sides, between Bachman Avenue and Bean Avenue; SECTION II - BROADWAY DISTRICT (1985 -7) 1. STOPPING STANDING OR PARKING PROHIBITED. Stopping, standing, or parking of a motor vehicle in excess of two (2) hours without a Preferential Parking permit or Guest Pass issued by the Town of Los Gatos is hereby prohibited between the hours of 9:00 A.M. and 6:00 P.M. Monday through Friday on the following street(s): a. Broadway, both sides from South Santa Cruz Ave to Lingley Ave. (West Main Street) SECTION III - LEROY AVENUE DISTRICT (1986 -32) �r0jJTvWr4IJ1l 110,101a" Stopping, standing, or parking of a motor vehicle without a Preferential Parking permit or Guest Pass issued by the Town of Los Gatos is hereby prohibited between the hours of 10:00 A.M. and 7:00 P.M. daily on the following street(s): a. Leroy Avenue, north side, from a point 65 feet westerly of the west curb line of Los Gatos Boulevard to a point 485 feet westerly. b. Leroy Avenue, south side, from a point 162 feet westerly of the west curb line of Los Gatos Boulevard to a point 385 westerly. SECTION IV - EDELEN DISTRICT (1989 -186) 1. STOPPING, STANDING, OR PARKING PROHIBITED. Stopping, standing, or parking of a motor vehicle without a Preferential Parking Permit or Guest Pass issued by the Town of Los Gatos is hereby prohibited between the hours of 6:30 P.M. and 2:00 A.M. daily on the following street(s): a. Edelen Avenue, both sides, from Mullen Avenue to Bentley Avenue b. Miles Avenue, both sides, from University Avenue to Los Gatos Creek Channel. C. Mullen Avenue, north side, from University Avenue to Edelen Avenue. d. Bentley Avenue, both sides, from University Avenue to Edelen Avenue. e. University Avenue, both sides, from Mullen Avenue to Saratoga Avenue. SECTION V - PERMITS 1. THE FOLLOWING PARTIES are entitled to Preferential Parking permits. a. Each resident in the preferential parking zone is entitled to one permanent parking permit for each vehicle registered to his /her residence address or name, with a maximum of four (4) permits for each individual address. b. Each resident is also entitled to two (2) Guest Passes for each residence address for temporary use only. C. One visitor permit shall be issued to any non - resident owner(s), for the sole use of visiting /inspecting the owner's property unless the owner is also a resident within the same district and already possesses Guest Passes issued in accordance with item (b) of Section V d. Residents who are eligible for Preferential Parking permits may apply for Special Event, temporary parking permits to accommodate one time multitude of visitors. SECTION VI - ASSESSED FEES: 1. The Town Council has determined that it is reasonable to expect cost recovery for the administration of the Preferential Parking Districts and the following fees apply to all Preferential Parking Districts. a. Ten dollars ($10.00) per vehicle for each parking sticker issued pursuant to Sections I through Section IV. (1991 -94) b. There is no charge for the two visitors passes issued. C. Five dollars ($5.00) is levied to replace lost visitors permit(s). No fee is charged to replace damaged permits if the damaged permit is returned to the Town Clerk. d. Five dollars ($5.00), non - refundable for the first Special Event Permit and one dollars (51.00), non - refundable, for each additional Special Event Permit. SECTION VII - APPLICATION AND RENEWAL 1. Residents are required to complete an application form listing no more than four vehicles eligible for Preferential Parking Permits. 2. Residents must present proof of residency to the Town Clerk. 3. Non owner residents must present a cancellation form from the owner which cancels any past residents at that Assessors Parcel Number and a verification form which attests to knowledge of the new resident at that Assessors Parcel Number. 4. Preferential Parking Permits are renewed on January 1st of each calendar year. Renewals can be made by verification of renewal form forwarded to resident of record by mail. Renewal form must be signed and returned by mail with the appropriate fee(s). 5. Residents adding or deleting a vehicle need to complete a new form. 6. Permits are registered to the address submitted on the application form. A change of address within the parking district requires a re application for new permits. SECTION VIII - OUTSIDE ZONE (1985 -85) Hardships may exist for some residents living close to, but outside, Preferential Parking districts. Therefore, the following procedures are incorporated. 1. The Town Clerk is authorized to issue parking permits to residents living within 100 feet of a permit parking zone when the Town Manager, or designate, certifies in writing that a significant hardship will result if a parking permit is not issued to such resident. 2. For the purpose of determining such hardship, the Town Manager, or designate, shall consider the following: a. The availability of parking on the applicant's property. b. The availability of unregulated on- street parking in the vicinity of the applicant's property. SECTION IX - SIGNING The Director of Parks, Forestry and Maintenance Services is hereby instructed to install appropriate signs and /or curb markings giving notice to the public of this action. SECTION X - RESCISSION OF PRIOR RESOLUTIONS All other prior Resolutions, 1983 -4, 1983 -76, 1985 -7, 1985 -85, 1986 -32, 1989 -186, 1989 -208, 1990 -215 in conflict herewith, are hereby rescinded.
