1992-190-Adopting The Town's Source Reduction And Recycling Element As Household Hazardous Waste ElementRESOLUTION 1992 -190 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ADOPTING THE TOWN'S SOURCE REDUCTION AND RECYCLING ELEMENT AND HOUSEHOLD HAZARDOUS WASTE ELEMENT WHEREAS, California Public Resources Code Section 41000 requires the Town of Los Gatos ( "Town ") to prepare, adopt and submit to Santa Clara County ( "County ") a Source Reduction and Recycling Element ( "SRRE ") that proposes programs to reduce or recycle 25 percent of the Town's solid waste being landfilled by January 1, 1995, and 50 percent by January 1, 2000; and WHEREAS, Public Resources Code Section 41500 requires the Town to prepare, adopt and submit to the County a Household Hazardous Waste Element ( "HHWE ") that proposes programs to safely collect, recycle, treat and dispose of household hazardous wastes generated by households in the Town and which should be separated from the solid waste stream; and WHEREAS, pursuant to Public Resources Code Section 41793, the Town Council of the Town duly noticed and the Town staff conducted a public hearing on July 30, 1992, to receive testimony on the preliminary drafts of the SRRE and HHWE; and WHEREAS, pursuant to Section 18766 of Title XIV, Chapter 9, of the California Code of Regulations, the Town Council of the Town duly noticed and conducted a second public hearing on October 5, 1992, to consider the final drafts of the SRRE and the HHWE, and the Town Council has considered all the comments of the members of the Council and the public on the SRRE and the HHWE; NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY RESOLVE AS FOLLOWS: CSD08 * \RES0S \CS100592.190 -1- The Town Council has considered and hereby approves the mitigated Negative Declaration prepared for the SRRE and the HHWE and finds that the project will have no significant environmental effects, as shown in said mitigated Negative Declaration, for purposes of the California Environmental Quality Act. The Council hereby approves and adopts the SRRE and the HHWE in accordance with the above determinations. The Council hereby directs the Town Manager or his designee to transmit the SRRE and the HHWE, on behalf of the Town, to the County for incorporation into the County -wide Integrated Waste Management Plan. Proposed Activ.cies for Source Reduction, Page 2 Recycling, Composting, Special Wastes and Public Education in Los Gatos, 1992 -2000 Source reduction activities proposed for implementation between 1995 and 2000 include: 1) reviewing a program to establish land -use requirements that promote source reduction planning. 2) monitoring efforts at the state level to encourage source reduction, including advance disposal fees, public education efforts, and other programs. 3) monitoring national source reduction efforts and trends in manufacturing and packaging to identify any potential areas for source reduction credit. Recycling activities Recycling activities proposed for implementation before 1995 include: 1) continuing Town- sponsored programs throughout Town offices and operations. 2) increasing participation and recovery rates in residential curbside and multi - family collection programs. 3) increasing participation in the commercial /industrial corrugated cardboard recycling program. 4) encouraging the landfill operator to expand the diversion program for targeted materials (eg: white goods, and other metals) from self - hauled loads. 5) evaluating a program of regulatory approaches, such as zoning, building code, and land use requirements to promote recycling activities. 6) implementing a market development program via a recycled products procurement policy. Recycling activities proposed for implementation between 1995 and 2000 include: 1) implementing a mixed paper (includes magazines, colored ledger and "junk mail ") collection program. 2) initiating a program to divert inert solids generated by Town agencies (e.g., department of public works, municipal utilities, and capital improvement projects). Materials could include inert solids, metals and corrugated cardboard. 6) monitoring efforts at the state level to encourage recycling, including financial and economic incentives, public education efforts, and other programs. Compostinc Activities Composting activities proposed for implementation before 1995 include: 1) continuing the residential yard waste collection program. 2) implementing a residential yard waste collection program, and disseminating public information about the program. 3) encouraging landfill operators to . o expand the diversion program for yard and wood wastes, from debris boxes and self - hauled wastes. 4) encouraging a countywide marketing program for the distribution of end - products. 5) supporting the concept of a regional composting facility. Composting activities proposed for implementation between 1995 and 2000 include: 1) maximizing recovery rates from the residential yard waste collection program. The program is an ongoing one, and therefore any incremental costs associated with operating the program should be minimal. The educational programs will also be continued. 2) encouraging landfill operators to continue the diversion Program for yard and wood wastes from industrial (debris boxes) generators. Proposed Activ ies for Source Reduction, Page 4 Recycling, Composting, Special Wastes and Public Education in Los Gatos, 1992 -2000 3) encouraging wood waste diversion programs from the self -haul sector. 4) implementing program to encourage use of compost by parks and highway departments and other public entities. 5) initiating yard waste collection services from multi - family dwellings, and from the commercial and industrial sectors. 6) studying the feasibility of co- composting yard waste with organic materials. 7) studying the feasibility of a commercial program that will focus on the separate collection of food wastes. Restaurants and other large generators of food wastes will be targeted. special wastes Activities Special wastes activities are managed primarily by the landfill operator and the City of San Jose, which is the Local Enforcement Agency for Guadalupe Landfill. These activities are to be continued from 1992 to 2000. 1) Special waste activities to be continued include the disposal of; _: • Sewage sludge; the City of San Jos& is the responsible agency. • Ash; only Class III landfills may accept for disposal. • Asbestos; Class III landfill disposal; the landfill operator is the responsible party. • Abandoned vehicles; removed by private, Town- contracted towing companies and sold to salvaging operations. • Dead animals; responsible parties include Santa Clara County Animal Control Department, a County contract with a private firm, and animal owners. 2) Continue diversion of tires; responsible parties include the landfill operator and the City of San Jose. 3) Continue white goods processing; responsible parties include the waste hauler and landfill operator. Mucation and Public Information Activities Education and public information activities proposed for implementation between 1992 and 2000 include: Propos,ad :'krt: ties for Source Reduction Recycling, [c.,_,osting, Special wastes and Page 5 Public Education in Los Gatos, 1992 -2000 1) expanding existing education that addresses solid waste management generally. 2) preparing /printing home compost brochures. 3) purchasing prepared activities brochures. 4) preparing directory of reuse /repair businesses. 5) preparing special waste disposal guide. 6) preparing do- it- yourself waste evaluation guide. 7) preparing residential and commercial /industrial yard waste collection brochures. Funding component While funding is not provided by AB 939, the regulations based on this law allow municipalities to levy fees (either directly on residents or passed through costs from the waste hauler) to pay all program costs. The Town intends to make adjustments to its existing rate system to fund the implementation of the provisions Of AB 939 and other applicable legislation. Consistent with current procedure, the Solid Waste Program and budget will be presented to Council each year during the refuse rate adjustments process. All costs necessary to implement the Solid Waste Program will be included in those budgets And will be recovered through the refuse rates. (CIWMB), and the County of R. Comments from the Los Gatos community Services Commission: 1) The Preliminary Draft was described as it comprehensive report which has covered a wide range of activities. it The residents and businesses of the Town of Los Gatos are responsible for the 22.3 per cent diversion rate in 1991. Moreover, participation in the residential recycling programs ranks as one of the highest in Santa Clara County. The Town anticipates exceeding the 1995 mandate of 25 per cent diversion before 1995. B• CIWMB comments and the ToWn's responses: 1) Calculate the quantities diverted from the municipal waste stream by existing programs, as well as anticipated quantities to be diverted in 1995 ando2000 for those Programs which will be continued as well as those planned for implementation. All calculations were made and incorporated into the Source Reduction, Recycling and Composting Components, and summarized in various other components, where appropriate. This information is required by AB 939, and is the only mandated information which was not included in the preliminary drafts for any of the West valley jurisdictions due to time constraints. 2) Include a volume measurement (cubic yards) in the final Waste Generation Study (Section 2) of the total solid waste disposed. The consultant that conducted the study and prepared the results added the information requested. Requested Revi: ns to SRRE /HHWE Page 2 3) Describe the existing residential curbside recycling program in terms of what is done, by whom, where the recyclables go for further processing or sale, and who is responsible for obtaining the markets for the recovered materials. The requested information was added to the Recycling Component. C. Santa Clara County comments and the Town's responses: 1) Clarify whether or not Green Valley Disposal Company has an exclusive franchise to collect and divert inert wastes (concrete and asphalt) generated by residents or businesses. Text was added which explained that GVDC does not have an exclusive contract to collect inert wastes or any other material types which are intended for recycling. 3) The Preliminary Draft was described as " . well - written and organized. . . . The Element contains thorough descriptions of the selected source reduction, recycling, composting, special waste, and public education programs." SRRE REV.LG
