RESOLUTION OF THE TOWN OF LOS GATOS
AUTHORIZING AGREEMENT BETWEEN THE TOWN
AND THE LOS GATOS WEEKLY -TIMES NEWSPAPER
FOR LEGAL ADVERTISING FROM
NOVEMBER 1, 1992 THROUGH OCTOBER 31, 1994
RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa
Clara, State of California, that the TOWN OF LOS GATOS enter into an agreement
entitled, AGREEMENT FOR ONE YEAR CONTRACT REGARDING LEGAL
PUBLICATIONS with the Los Gatos Weekly -Times attached as "Exhibit 1" and that the
Town Clerk is authorized to execute said agreement in the name and in behalf of the
TOWN OF LOS GATOS.
PASSED AND ADOPTED by the Town Council of the Town of Los Gatos at a
regular meeting held this 19th day of October, 1992 by the following vote:

AGREEMENT WITH THE LOS GATOS WEEKLY -TIMES FOR PUBLICATION OF TOWN'S
LEGAL PUBLICATIONS FROM NOVEMBER 1, 1992 TO OCTOBER 31, 1994
This agreement is entered into on October 30, 1992 between THE TOWN
OF LOS GATOS and the LOS GATOS WEEKLY TIMES, a newspaper of
general circulation within the Town of Los Gatos. This agreement shall be
for the publication of all Legal Town Notices and shall be for the period of
November 1, 1992 to October 31, 1994 (two year provision) and shall be as
follows:
SCHEDULE OF RATES:
The schedule of rates for ANY ISSUE shall be $6.95 per
column inch.
A guaranteed standard price of $60.00 for 4 1/4 by 3 5/16
DISPLAY ADS with varied borders for Commission /Board
and other vacancies. A guaranteed standard price of $30.00 for
2 1/16 by 3 5/16 DISPLAY ADS with varied borders for
Commission /Board and other vacancies and shall be in the
form as shown in EXHIBIT A.
One quarter page size free editorial space each and every
publication for the purpose of advertising Town meetings,
information and other activities. This space to be available in
all issues regardless of whether any legal ads are placed. This
space may not be used to publish legal notices but may be used
to publish public information. The positioning of this space
will be above the Legal Notices and will be set with a defined
border. The Town of Los Gatos shall maintain editorial right
to this space. The contents of the Editorial space will not be
changed more than once per month and shall be in the form as
shown in EXHIBIT B.
DATE OF PUBLICATION
The specific dates of publication shall be WEDNESDAY of
each week from November 1, 1992 through October 31, 1994.
"EXHIBIT 1"
DEADLINE FOR REGULAR PUBLICATION
The deadline for regular publications shall be FRIDAY, at
3:00 P.M. or Thursday at 3:00 P.M. if Monday is a holiday.
The Town of Los Gatos shall provide computer discs with those
items to be published. The Los Gatos Weekly Times shall
provide a weekly courier service to the Clerk's Office by the
regular deadline day and time - FRIDAY AT 3:00 P.M. or
THURSDAY AT 3:00 P.M. if Monday is a holiday.
The courier shall sign a release form and accept responsibility
for delivery of disc and hard copy to the publisher. The
publisher shall furnish a return of transmittal by FAX by 5:00
P.M. on FRIDAY to the attention of the Town Clerk AND
SHALL BE LARGE ENOUGH TO BE READABLE
The courier shall return the previous weeks disc to the Town
Clerk's Office.
Deadline for final changes of regular copy shall be MONDAY,
AT 10:00 A.M. or FRIDAY AT 10:00 A.M. if Monday is a
holiday.
EMERGENCY DEADLINE FOR PUBLICATION
The Los Gatos Weekly Times shall provide for emergency
legal notification as they may occur from time to time. This
deadline shall be MONDAY AT 10:00 A.M. prior to the
Wednesday Publication or FRIDAY AT 10:00 A.M. if Monday
is a holiday.
PUBLICATION OF NOTICE TO BIDDERS
The Town will indicate the number of times that a publication
is to be printed by including publish dates at the bottom of the
notice. However, the Los Gatos Weekly Times accepts and
acknowledges that Notice to Bidders are to be published twice.
PUBLICATION DAY AND /OR DATE CHANGES
The Town of Los Gatos shall be notified IMMEDIATELY of
any changes in scheduled publications due to holidays and /or
acts of God.

DOCUMENTATION OF BILLING
Provisions will be made by the Weekly for individual separate
billing for the Town Clerk's Office and the Town Planning
Department.
Invoices are to include itemized billing on charges per column
inch for each department.
No finance charge shall be levied until the balance of the
Town's legal account is over 90 days.
PROOF OF PUBLICATION
The Los Gatos Weekly Times shall provide the Town Clerk and
the Planning Department with two (2) ORIGINAL copies of all
legals as PROOF OF PUBLICATION, as required by law. The
PROOF OF PUBLICATION to be received by WEDNESDAY
of the publishing week or THURSDAY if Monday is a holiday.
The Los Gatos Weekly Times shall furnish the Town with a
minimum of ten (10) copies of the publication when delivering
the Proof of Publication.
PROOF READING SERVICES
The Los Gatos Weekly Times will not provide the Town with
proof reading services for legals. However, the Los Gatos
Weekly Times WILL PROVIDE A PROOF BY 10:00 A.M.
MONDAY for verification and approval by the Town Clerk
and /or Planning Department.
FINAL PRINT SIZE OF LEGAL PUBLICATIONS MAPS AND OFF SET
The guaranteed print size shall be no smaller than ten (10)
point and all legals will be off set in a two (2) point box and
shall be in the form as shown in EXHIBIT C. (Acceptable size
and NON Acceptable size).
Maps shall be reduced no more than 50 % for publication.
The Town of Los Gatos reserves the right to review the format
and to make changes, if necessary, for readability.
NON DELIVERY OF PUBLICATION
A weekly publication of both a Town telephone number and
the newspaper telephone number shall be published with a
heading in bold indicating 'contact the Los Gatos Town Clerk's
Office at 354 -6834 or the Weekly Times at 354 -3110 if your
paper is not delivered ".
CANCELLATION
If a problem with circulation arises and the Town of Los Gatos determines
that legal Public Notices are not being circulated as prescribed by law or for
any other material breach of obligations set forth in the Agreement, the Town
of Los Gatos may cancel this contract upon two (2) weeks written notice.
PROOF OF CIRCULATION CAN BE REQUESTED AT ANY TIME BY THE
TOWN OF LOS GATOS.
IN WITNESS WHEREOF the parties hereto have caused this Agreement to
be executed in the Town of Los Gatos, State of California.
