RESOLUTION OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO SIGN AN
AGREEMENT WITH BEN & GARY'S COMMUNITY PHARMACY
FOR WORKERS' COMPENSATION PRESCRIPTION SERVICES
RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa
Clara, State of California, that the Town of Los Gatos enter into an agreement with Ben
& Gary's Community Pharmacy for Workers' Compensation Prescription Services on the
terms and conditions outlined in attached Exhibit A, and that the Town Manager is
authorized, and is hereby directed, to execute said agreement in the name and on behalf
of the Town of Los Gatos.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 19th day of October, 1992 by the following vote:

THIS AGREEMENT, made and entered into this day of
1992, by and between the TOWN OF LOS GATOS and BEN & GARY'S
COMMUNITY PHARMACY.
1. The Town of Los Gatos requires the pharmacy to provide prescription
and medical supplies for employees of the Town of Los Gatos, and to
provide such services upon the terms and conditions hereinafter set
forth.
2. WORKERS'S COMPENSATION
A. Pharmacy shall contact Third Party Administrator for authorization on
all initial prescriptions;

B. No contact is required for prescription refills as indicated
by physician.
C. Generic substitutions shall be dispensed unless contra - indicated by
physician.
D. The charge for the prescriptions shall be from the "Red or Blue" Book
at the Average Wholesale Price, (AWP) + 1.75 per prescription per
processing.
E. All billing for prescription & medically necessary supplies shall be
submitted to the Third Party Administrator for payment.
F. Third Party Administrator shall pay for all authorized prescriptions
and medically necessary supplies within thirty (30) days of receipt of
billing.
G. The Pharmacy is open from 9:30 a.m. - 6:00 p.m. Monday through
Friday and has a 24 hour emergency phone (356 -0822) for off hours.
3. NON WORKERS COMPENSATION
A. A discount of 10% will be provided on all purchases to employees of
the Town of Los Gatos with appropriate identification.
B. Employees not utilizing Worker's Compensation coverage shall be
solely responsible for the payment of all purchases.
4. This agreement will remain in effect for one year from the date of approval
unless terminated according to the provisions of this Agreement. The parties
may review this Agreement for subsequent one year terms upon mutual
written agreement prior to the anniversary date.
5. Either party may terminate this Agreement without cause upon thirty (30)
days written notice.
