RESOLUTION DENYING AN APPEAL OF A DECISION OF THE
PLANNING COMMISSION TO DENY A REQUEST TO MODIFY
PREVIOUS APPROVALS GRANTED FOR THE CONSTRUCTION OF
A SINGLE- FAMILY RESIDENCE IN THE R- 1:8000 ZONE,
ARCHITECTURE AND SITE APPLICATION S- 81 -35A
(LOCATED AT 17161 PINE AVENUE /OWNER JIM NIELSEN)
WHEREAS:
A. Property owner, Jim Nielsen, applied for approval of plans to convert
previously approved attic space into floor area that will result in exceeding the allowable
Floor Ratio Guideline as prescribed by the Town Code (Architecture and Site Application
S- 81 -35A);
B. The Development Review Committee reviewed the application on September
15, 1992, recommending approval if the Planning Commission could make findings for
approving the projects over the Floor Area Ratio as required by the Town Code Section
29.40.075(c);
C. The Planning Commission considered the application on September 23, 1992
and denied the application;
D. On October 2, 1992 the property owner, Jim Nielsen, appealed the Planning
Commission's decision; and
E. The Town Council held a public hearing on November 2, 1992.
RESOLVED:
The Town Council finds that the Planning Commission did not err in its denial of
Architecture and Site Application S -81 -35A. The Town Council upholds the Planning
Commission findings that if this design had been proposed originally at the time of the
application, it would not have been approved.
Pursuant to Los Gatos Town Code Section 1.10.085, the time for seeking judicial
review for the Town Council decision is governed by California Code of Civil Procedure
Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 16th day of November, 1992 by the following vote.
